I understand your frustration, by the way you just filed your case in N400applicant....|08/01/12|07/31|--/--|08/11|08/24/15|--/--/--|--/--/--|--/--/--.|--/--/--|Baltimore, MD

You had your FP taken 8/24/2015, Its not been even 2 months yet, and you start to get worry, please calm down cause it way to early to even worry about anything. It usually takes 72 hours to clear FBI background check or Name check, Sometimes it takes 3 months and some times it takes 6 months, because if your name "hit" the FBI database for same name and date of birth and country of origin. So they have to look up more detail which is time and labor intensive.

I agree with you, taking too long to resolve the issue or security check is not good thing, If someone is bad a guy 1 day is also a too much to have him loose in open air. But we are talking about the most immigrant populated country in the world. Immigration is out of control , too many immigrants and not enough resources.

Probably i will tell you right now, looking at those VJ filers and comparing them with yourself is very bad idea. EVERY CASE,EVERY PERSON, and EVERY SITUATION is different. You cant blame your USCIS office why your friend or neighbor got interview before you or got naturalize before you. USCIS DON'T KNOW YOU NEITHER THEY CARE HOW MUCH YOU ARE IN HURRY, OR HOW BAD DO YOU NEED THIS DONE.

Its all about a Black box, when you hit , its done quick , if its doesn't hit it will take time.

Another thing i tell you that , Baltimore, has same day ceremony so it will take longer then other offices to do interview, cause your likely to receive your certificate same day or week after.

Another thing taking USCIS to court, you are talking about American's most powerful federal organization which has power and legal ability to do anything with your application, Alot of lawyers dont even want to takeup your case cause unless its 3 to 4 years mark.

i really hope you get your interview soon, and please please be paitant you will hear something in few months, it will get done sooner or later.

Stay positive, It will over before you know it.

God Bless you and i wish you all the best:)

mohdirfan08787,

If 50 people apply today, 45 get interview scheduled in 10 days and 5 must wait 3 years, how is it not USCIS fault?

They talk about security check, I don't believe it, it's hogwash. Here are two main reasons to doubt their "security" excuse to arbitrarily abuse power:

#1. If there was genuine security threat, not only one day would be too much to leave someone in the loose, but I assure you FBI or SWAT team would show up at the door next morning after sending app. at 4am, if there was a real threat coming from applicant. Moreover, it would be BAD BAD BAD move for FBI and DHS NOT TO SHOW UP and NOT to arrest someoneone immediately, if they were really a security threat. No bureaucrat would risk their warm office and allow someone to stay free indefinitely if "security" was a concern.

#2. Second reason I stringly doubt their "security check" mantra, is that almost every case I have read about where people bring the WOM and sue USCIS, they somehow magically get the security check complete (almost instantly, and before case goes to court).

Question: what were they doing for a year (or years) while applicant was languishing and waiting for them to process his or her case?

This is pure intimidation and bullying, deliberately designed to make certain immigrants "know their place", so to say. There is no genuine "security" concern behind it.

Moreover, it's a pure speculaiton at this point to suggest that anyone's case is held up due to security check, because they will never tell you WHY they are not processing your app. Anything could be a reason for excessive deay. Someone could simply be lazy and never bother to look up your case, because they are "overwhelmed" with the work they don't want to do. Or someone could be a member of a sect with bigorty and bad feeling about your country of origin, and that person could be an officer in charge of processing your applicaiton, and may feel self-righteous about "punishing" you for what they blame others for.

And you will never know WHY precisely YOUR case had to wait 8 month to be scheduled for interview, while others who sent apps the same time you did had sworn in 5 months ago.

Remember, we do have a principle in this country which is called DUE PROCESS OF LAW. It's a violation of DUE PROCESS OF LAW to subject immigrants , without any explanation, to such arbitrary whim of bureaucrats.

It may be that all the Courts in our times are accepting these kind of violation as "OK", it may be that no one agrees with you that it is wrong to arbitrarily abuse some immigrats and delay processing their case for no good reason, it's possible that you can NOT bring WOM in Federal Court until 20 years passed from date of your filing your case. But that does NOT make it right, nor does it deny the fact that we have a principle of DUE PROCESS OF LAW and it is in fact being violated in many cases.

Just as slavery wasn't right, when it was widely accepted and ruled "legal" , so I am telling you THIS is not right.

And, finally, let me tell you: I am not worried. If I was worried I would be very scared to come and voice my opinion here. We live in XXI century, all communications are traceable (I don't use a proxy and don't hide behind any remote servers), and speaking up on internet is the same as speaking up in front of the WHhite House. So, if I was worried the last thing I would do is to come and openly say what I think of this bureaucrats in charge of delaying our apps.

But I am very much upset with the fact that principles this country was bult upon, DUE PROCESS OF LAW among them, mean less every day. It's called a Grievance. And I have every right to peacefully express it, which is exactly what I do by writing here what I observe to be the case.

Being patent or staying positive will not change the fact that some bureaucrats have arbitrary power to do as they wish and are not accountable for their actions.

But speaking up may help to alert greater number of people in the community, and cumulately can lead to a change in future, May be that change will happen long after we benefit from it, but we can not be so selfish as to think only about ourselves and quietly stay patient. We must speak up so people know what is happening with some of the cases processed by USCIS.

First Amendment and separation of Church from State has a lot more to it than most of our contemporaries realize.

The truth is, the Pilgrims were Puritan fascists who were only looking for their
own
religious freedom. They were too ... independent and fanatical even for the more mainstream zealots of English and European Reformations. They called themselves “Puritans” because they were dedicated to
purifying
the Church of England of Roman influences. They
hated
Rome and they
hated
heretics, and they
hated
sinners and they really hated
witches
. Their reigning English King, James I was also a foaming Protestant Scottish witch hunter, and was every bit as fanatical as the Pilgrims were, since they were all theological soul mates. But James I actually had to sophisticate himself a bit, particularly stifling his witch-hating fanaticism when he took power in England. He had to accommodate the more moderate and educated Protestantism that then still held great sway in his English Court and Parliament. This social moderation at home however, didn’t slow him from encouraging the exportation of sharp, Puritan zeal to his growing colonies in the New World though, where raw Puritanism would be free to dominate the new society he intended to found there.

I say with very little exaggeration, that living under Puritan rule in the New England American Colonies would be nearly as religiously oppressive as living under the Taliban in Afghanistan, or Wahhabi ruled Saudi Arabia. The principle difference between Sharia Law and Pilgrim Law would be that the Pilgrims let women show

their whole faces in public. the Puritans in particular on the other hand, weren’t all that put off by the Inquisition’s tactics or even goals in and of themselves. The Puritans and many other Reformers in truth just wanted the Inquisitional zeal applied unilaterally up and down the Church ranks from clergy to commoner. They just didn’t think you should be able to buy or politic your way out of being tortured into a confession of heresy. They figured that kings, Popes and bishops and priests were just as good candidates for heresy as anyone else—the more the merrier. Puritans in short, actually wanted
more
repression and
more
micromanaging of the Body of Christ. They wanted the power to institute the same sort of fanatical purification of Christendom that the Inquisition only
pretended
to enforce, and then only selectively, often for personal, social, or political reasons. The Puritans wanted their newly cleansed Protestant Inquistition to be
universally
applied to all Christians of whatever rank. The Puritans wanted
everyone
to be beaten into piety whatever his station in the Church or society– they just wanted to insure it was being done fairly and correctly by a dictatorial theocracy of their
own
design. We read about the Salem Witch trials, some decades after the Pilgrims landed, and think that hanging nineteen men and women as witches on the say-so of a couple of snotty little girls looking for attention was a fluke carried out by an isolated, small group of inbred fanatics. We think the old man they crushed under stones for refusing to submit to their trials was the result of some abnormal paranoia due to the bunker mentality of a pioneer colony in a harsh new land. When we read about the dozens of fellow colonists they just let rot in jail for months as they queued them up for their American Inquisition, we assume that this sort of fiendish treatment had to be the product of some sort of atypical mass mental illness brought about through a bad diet and not enough sunlight. But no,
that’s what Puritans did

They have power given by INA " Immigration and Nationality Act " nothing more.

Remember they give us a booklet which says no one is above the law. Why it is when people take them to court after one year mark name check gets cleared in two days ?

guys, it has been 6 months after my biometric appointment. i still have not heard any updates from USCIS yet. I have made an appointment with local USCIS office and see if they can figure out where went wrong. i know that LA office has been having backlog but i doubt the cause of my delay is because of background check. I called USCIS customer service but they were not able to tell me if it was done or not. Let's see what they have to say next monday, i will keep you updated.

It's a horrible waiting game, you should hear something soon. I waited 8 months from biometrics until getting inline and interview scheduled. Some people get it processed quickly and others, like you and I, wait a long wait. I know it is frustrating but soon enough you will hear something. Just remember, there is no rhyme or rythem when it comes to immigration.

Dayyum...what a rant!!! what everybody forgets is federal officers are also human...have families...go thru the ups and downs of life like everybody else and yes they make mistakes like everybody else. So chilllllllllll buddy. Nobody is out there to get you. They dont give two sh**ts about your contry of origin either.
