I would have him removed the tattoo and ask embassy for the chance of second interview. He could mention that he wasn't aware of that tattoo could be related to any group he did that when he was teenager just because it was fun among teenager and it was in trend. He could prove he is not affiliated by showing no criminal charges until now, and two close witnesses signature and notarized that they know he is not related to any criminal gang group. That is all I can think..

When interviewing, the only acceptable answer to a CO's question is a truthful one, not some made-up story.

How do you prove a negative, most gang members have not been arrested, still gang members.

You can not get Police Reports in Mexico, not required by the Consulate.

And as has been mentioned removing it now is too late, common issue with CDJ and an experienced Lawyer would have asked.

The country reciprocity schedule has changed, police records are now considered available in Mexico and may be required now.

They should stick to the truth, not something someone told them to say.

Removing the tattoo will be the first step to show evidence to the contrary. He can still ask for another interview and tell his story.

they are already aware of the tattoo, so removing it won't change the fact they think he is affiliated with a gang.

So my 2 cents, While I do feel sorry for you and your loved one, I also admire our USCIS officers attention to detail, especially in light of the hispanic gang violence that goes on in the usa. I also applaud your husband for doing this the legal way and not simply walking across our unsecured border to the south.

That being said, I wish you luck and if it is truly not a gang tattoo, I hope that the process will work out for you both. But keep in mind these people are trained in what to look for as much as prison gaurds are trained to pick out gang members and isolate them from the non-gang affiliated population.

Is it a Gang Tattoo?

There are experts on such matters if it is not and you wish to dispute it.

Very much depends what it is, you were not clear.

Yes, it's a gang tattoo and there's no way a Hispanic man would dare to get such a tattoo unless he's actually affiliated with a gang. To have a tattoo done like this "just because it's cool" would be like stamping a note on his forehead that says, "kill me now". A gang tattoo isn't body art, it's a brand and it's taken very seriously among gangs. Consulates in Mexico are well educated about such facts. Of course he was denied. I'm just so surprised he didn't think of that when going to his interview.

Ok so my husband had his interview on June 4 and they were asking him has he ever been in a gang he said no to make a long story short he got denied do to reason to believe he is affiliated to criminal active so what do I do from here do we have a chance to come together again legally we have been married for 8 years have 4 kids together I'm just sad I talk to my lawyer and they will fight this but I'm scared they won't let him back

Tats can be lifetime bars (real lifetime=no waiver) if found to be gang affiliated, even if he left the gang

Your atty should get you to a reputable Tat expert to go over them & record the meanings formalrly for DOS

interpetton Many South American embassy does this & its is even harder than CIMT to fight because

itss almost zero chance. Tats: tear-drop, numbers, zip-code M13, joker. some chinese

writings is a no no....People immigrating should wait until they go thru the process B4 getting tats it can

be a permanent bar if they decide its gabg related

Listen I was in a gang when I was younger and had an extensive criminal record, I would call attorneys and non would take my case. they said they didnt want me to get deported and take my money. I have been in public service for decades loyally serving my community and I have not associated with any gangs for over 25 years i finally said Im tired i have everything here I have been in the US since my mother died when i was a year old. I dont know anyone in the country i was born in and I was even Adopted by my US born father @ 15 years old and my adoptive mother got her citizenship when i was 19 and no one would take my case one attorney got so mad at me he said i was trying to thread a toothpick through a needle because I had a 20+ year old drug charge conviction that if i even tried to apply i would fall into automatic removal proceedings so he referred me to an attorney in LA that specializes in Criminal immigration cases. This attorney filled out my application and went with me to my interview Im happy to say I took my oath last week and after 40+ years of being in The US and 25 years as a LPR I can happily say with much relief that I am a Citizen of the only Country I have ever known and loved, this great experiment called America. i walked into his office almost in tears and he reassured me you are a good man that was raised in a bad environment, he could see how nervous i was he put his arm on my shoulder and said let me show you something he took me into his trophy room where he had news clippings of people he got approved for citizenship. he's amazing he told me of the countless cases he represented even a couple of guys who bombed an embassy and he got them approved for Citizenship..!!!

Ok so I would start off by saying I would have never blog if I new he was in a gang I don't support that nothing wrong with what you do but me personally I wouldn't of married him I know him for 9 1/2 years he came over 10 years ago we have been together pretty much since he has been here not one time has he associate with gang members he was 17 when I met him he got the tattoo when he was 21 he saw it at a tattoo shop and he love it when they stated it was a gang related tattoo he wanted to cry to no that the only thing holding him back to see and be with his family was something that don't mean be hide. And yes he did come over here the wrong way ok he made a mistake I get it but I also think they don't think they would have found a woman and made 4 beautiful kids over in the USA so ok sorry about that now he is trying to do it the right way and he is being judge by his tattoo that don't mean nothing to him I didn't want this to be a pity party on r behalf but like I stated before I would have never blog knowing he has been in criminal active...removing the tattoo he is willing to do that but at the end of the day they no what where it is and that isn't going to change on how they feel about him so I hope everything does work in are favor but I feel like we have no chance it hurts explaining to r kids why there father isn't here and has been a very active father in their life since birth them crying acting out hitting biting it's been a hard struggle not to mention I'm pretty much a single parent I'm struggling he was 80% of income now I'm going to not only loose the man I fell in love with but everything me and him work so hard for this is wrong but there is nothing I can do feeling really depressed sad and torn
