Some back story:

Dad entered the US back in 2010 through Visa Waiver Program. He should not have due to prior criminal stuff in his youth. Since then he's been granted a waiver of inadmissability for his Visas. The waiver is because he lied on his ESTA form which is Unlawful Entry to the US.

He currently holds a 5 year tourist visa.

Today he was denied his IR-5 immigration visa while his wife was approved. Apparently the unlawful entry will get you denied no matter if they allow you to visit.

The interviewer suggested she come across and petition for him once she receives her green card.

The interviewer also suggested that he may have a difficult time going through border control since he now has a "Denied immigration visa". She said it could be "awkward".

My question is how likely is he to get turned away at the border? His tourist visa is still valid.
