K1 Visa application which Consulate should we file at?

Hey everyone we're currently about to start off on our K1 visa application and was wondering if anyone could be of any help to us.



We are both currently residing in OZ which is where we met as colleagues, after 2 years of working together we began dating and have been engaged for 2.5 yrs. Our questions are,



  1. If anybody could advise us on whether we should be having our interview here in OZ (third party country) or if we would be better off having our interview in Malaysia?
  2. Could we just start off our K1 application from here in OZ and head to Malaysia for our interview?
  3. Would an application for B2 visa denial in OZ 2 years ago affect our K1 visa application?

Would appreciate any help and advice we could get from fellow VJ members so we could get our K1 application started off and fingers crossed start settling down back in the states if everything goes well.

Apply using your Oz residence. No need to go to Malaysia for the interview, have the interview where you live. Much easier to do.

1. Oz is easier for you; people almost always interview where they are legally resident.

2. IF for some reason you move for work, yes the case can be transfered.

3. No, unless he lied in the tourist visa application (such as said he was married to increase his ties to home).

You may have very good reasons to go for the K1 fiancee visa, but you might want to consider the CR-1 spousal visa too. It is cheaper and means he gets a greencard upon entry to the USA right away, so he can work or travel if there is a family emergency back home.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You can interview in the country where you reside as long as you are legally living there.

  1. Could we just start off our K1 application from here in OZ and head to Malaysia for our interview?

Yes, or just stay put.

No affect at all.

Yes we have our affidavit of support sorted out.

He is the USC. She wasn't approved for the tourist visa because of lack of ties to Oz since she was still on a student visa in Oz completing her degree.

You may have very good reasons to go for the K1 fiancee visa, but you might want to consider the CR-1 spousal visa too. It is cheaper and means he gets a greencard upon entry to the USA right away, so he can work or travel if there is a family emergency back home.

That is an option we had been weighing out as well only considering the timeframe as (he's USC) parents are getting older and would like us to be there asap.
