NinjaMax, the Montreal consulate from my experience answers emails quickly so it wouldn't hurt to try. To be honest, it shouldn't have been an issue but it was for me unfortunately.

CanadianYinzer, I agree when he told me that it annoyed me too. But I am glad to hear that things went well with you.

Now for another update, I'm currently at YUL waiting for flight 1 of 2 tonight. I went through the Nexus line and informed the agent I was activating a K1 visa, then handed over my passport, Nexus card, U.S. customs declaration card, and the sealed envelope. He walked me to secondary where another CBP agent went through my documents. I was asked to take a seat and 10-15 minutes later I was given my passport back without any hassle or questioning.

YAH!!! Congrats and hope that you had a safe flight.

they do not have pre-clearance there, im assuming its better to land on US soil and do it like that?

the other thing I was thinking of doing was taking the Bus to new york and going through the buffalo bridge.

Did you also have an expired NOA2 when you crossed?

If you are going to take the bus then you will be going thru Erie POE. Be prepared that the bus might leave without you on it as they have to keep on a schedule and it may take a bit to process your K1.

When I crossed at Lewiston, my NOA2 was expired but they didn't even look at that. They just looked at the visa in my passport. Processed me in 30 minutes and I was on my merry way.

I swear those busses are never on schedule. last time we had to wait an hour at customs because someone was getting grilled really hard for telling the officer they were visiting for 6 months and not explaining where they were going to say.

My best bet would be to go through billy bishop airport and avoid a potential power trip at pearson, I really enjoy porter airlines and its closer to me anyway. My only concern is that ill be on US soil when I go through customs, it will be a nightmare to get sent back.

Hello everyone,

So I'm in the U.S. now and the wedding took place on Friday. Believe or not, the CBP officer in Montreal did not enter my complete first name on my I-94 and now I have to get that sorted out before I proceed with my AOS...

Anyways it's been a whirlwind and I'm thankful for the community here. I hope this thread has been helpful, or at least has shed some light on what possibly could happen with an expired petition and a very uncooperative CBP agent. Although none of this should have happened to begin with, I hope that the steps I took to resolve this situation can help someone else in the future should it happen to him/her. To recap what I did:

- Contacted the consulate that issued my visa in the most direct manner possible

- Went in person to have my visa reissued and my package resealed (another option I was given was to mail my documents in)

- Left out of a different POE

- Filed a congressional complaint

Congrats on the wedding. That's crazy that the CBP officer get your first name wrong. Hope that don't slow down the process much.

A Canadian officer did not do this.

Many sites in Canada offer pre-clearance. Meaning an individual will clear US customs and immigration prior to boarding the flights. This is common in Canada as it allows flights to land in small airports would not otherwise offer CBP

good luck, congrats on your marriage HeathEve

To those who are concerned over their petition/NOA2 expiry date, just know that is not your K-1 visa expiry. This is just an (unforunate) example of what can go wrong if the CBP officer is being difficult and not knowing the rules. It's evidently a rare case on VJ and I never imagined it could happen to me.

As an update, I mentioned before that the officer at the Montreal airport inputted my first name incorrectly on my I-94 (only typed in half my name). I was able to get it corrected by a CBP Deferred Inspection Site, however they caused another issue for me. Now on my I-94 has a false departure date with no port of entry/exit listed (I am positive that this was created in error since the date of my "departure" matches the date th CBP officer corrected my name. The deferred I dealt with replied with this:

"The record in the CBP internal database is correct; the public I-94 search database appears to be showing a departure (9/28/2105) for some reason, which is nothing to worry about. Your application for converting your K1 visa to resident will not be affected by this issue. The USCIS officer assisting in your application will not be utilizing the public database as the only resource for your travel history. We hope that the name correction we entered has assisted you in obtaining the documents needed, and if you need any further assistance, please let us know."

I will be going to another CBP deferred inspection site later this month tp try getting it removed anyways. I have also made an Infopass apointment just incase that deferred inspection site won't do anything to correct my I-94's travel history. I hope this gets resolved so I can finally get an SSN and a driver's permit. What a ride to say the least.
