So she is using ONLY her income? Or is she using both her and her husband's income?

She is useing her income only.but she and he husband file tax together,

What does make it his difference if joint sponsor combine there spouse income .and file joint tax.

Ok, so if she using only her income and her income is enough then she will need to provide her W-2s.

You combine the joint sponsor and spouse's income only if the joint sponsor's income alone is not enough. Meaning the joint sponsor does not earn enough by themselves so they use their spouse's income too.

Yes her income is enough for joint sponsor .my wife made 16620 $ yearly to reach poverty line we need 3292 $ more.so we have a joint sponsor who is Mariied thy have 2 kinds .they both make 33000$ per year.so her income was enough for become joint sponsor so she fill out i864 .and she and her husband fillied tax together,so they gave us irs tax transcript.

I think you are confusing tax form with the I-864 form. Your sponsor needs to provide w-2s if he/she file taxes as married filing jointly to establish his/her income from his/her spouse if they are the only one sponsoring if they are both sponsoring then there is no need to

Ok, if she only makes $33,000 then she does not earn enough to sponsor your wife by herself. She is in a family of 4 and including your wife that would make 5. For 5 people, its an income of $35,512.

The husband earns $33,000 too? Their combined income is $66,000? If it is, have the husband complete an I-864A.

Ok, so their combined income is $33,000. That is not enough. They are in a family of 4 and are sponsoring you (sorry, i thought you were the petitioner before) meaning their household size is 5. In a household size of 5, they need an income of $35,512.

Also previously you said you were using only the wife's income. But, you say their combined income is $33,000 which is not enough to sponsor you.

Even though your wife earns $16,620, you cannot combine your wife and your sponsor's income. This is looked at separately. First they look at your wife's income. She does not earn enough so then they look at the joint sponsor's income to see if they can support you.

Again, you cannot combine your wife and the joint sponsor's income. Joint sponsor's income is looked at separately.

You need to be more clear in your questions to the NVC . that is why you get conflicting answer from them and on this site. For the most part you do not need w-2s with tax transcripts but there are exceptions and your is the exception without knowing the complete details someone will not be able to answer or you might get a wrong answer

OP before you mail out your AOS documents I think you need to sort out this joint sponsor since the way I'm understanding it, your joint sponsor does not make enough money to sponsor.

It's best to do it correctly the first time instead of getting a checklist.

I also agree with j&ana, you need to clearly state all the facts and then ask your question or else you will get different answers.

Feel free to PM me if you need help...

if can't combine wife and our joint sponsor income so at I-864 why they said 1st joint sponsor and 2nd joint sponsor?

The reason they have that is if for example let's say there are 2 people immigrating in a family. Petitioner's brother and brother's wife. Petitioner does not earn enough money so they get 2 joint sponsors.

The first joint sponsor only earns enough to sponsor 1 person (brother) so they are the 1st joint sponsor. The second joint sponsor only earns enough to sponsor 1 person (brother's wife) so they are the 2nd joint sponsor.

They are not combining their income with the petitioner. They are each sponsoring only one person in the petition.

In your case, it is only you immigrating and your wife (petitioner) does not earn enough to sponsor you. The joint sponsors also do not earn enough to sponsor you because their income is only $33,000.

Therefore, you will need to find another joint sponsor.

And from experience I can tell you that COs will not grant visas if the sponsor's income is not enough. I've had family friends interview at the embassy 7 times, yes, 7! Every time, due to lack of joint sponsor's income.

Question: Since their joint sponsor filed married, but only using their income, does an employment letter not help? Do they only accept the w2's with the transcript?
