advice on how to pursue fiance visa

Hi I am a new member looking for advice. I have met a woman living in malaysia. We skype daily, have been for months. Things have escalated quickly. She prefers that i somehow be able to reside there with her. But at this time its not that possible for me due to a few circumstances. Now we have talked about marriage and we are both very sincere in our decisions. I really just need advice on wether i should make attempt to travel to her,maybe marry there and go that route. Ideally i would like to have her her in america with me. Or should i consider the fiance visa option. Go visit her to meet the requirements and then return home to file for her visa. Ideally the fastest most economical route is preferred. I dont have unlimited funds to travel back and forth many times. I also care for my ill mother who is on oxygen 24/7 and cant do much without me being here daily. I know getting a tourist visa is sometimes iffy and our actions could be considered fraud and i do not want that. I have never travelled outside the united states. And yes i understand the skeptics point of view also. But i do believe that what we tell eachother is sincere,as she has never asked for anything from me except to be with me wherever we can work out. I just need advice from people who have been in same situation, as i have no one here to really ask. Any advice is appreciated. Fastest and most economical don't go together - you can't eat a cake and have it))) Fiance' visa is the fastest - 5-8 months, depending on how lucky you are, while spousal visa turns cheaper if you count the expenses for the Adjustmet of status, required after entering the US with the fiance' visa. Waiiting for the spousal visa takes about a year in average.

Thank you for your replies, im sure you have read the same story numerous times. sounds to me like you suggest travelling to see her to meet a requiremt for fianca visa, then filing and waiting the 5-8 months for it to be accepted and then she can come here. Am i correct? I will read the guides thank you.Also am i correct when i see that hiring an attorney is not absolutely needed? thank you again.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

How many months have you been Skyping? 8-9? When a relationship escalates quickly, just be mindful of the "skeptic's point of view," if it's been under 4 months. I'm just speaking through experience.

Best way is marriage and spouse visa

As many financee visas are denied and you end up doing the spouse visa

Travel and marry and do the 1 year going thru this. Yes, if financee visa is approved, it is faster but K 1 is so iffy now. Even countries that use to be granted K 1 (fiancee visa) are getting denied

and the cost to fly back and do the marriage and spouse later adds up

plus costs of AOS

This is just my opinion so take everything people say into consideration

if you ask 10 people what they think, you will get 10 different answers.

Thank you both for your advice, yes its only been a few months, i do appreciate all views and especially from those that have been through the same thing. I will consider all options. seems that the best route is to go there,make sure that we really do feel this way. And then consider the fiance visa versus spousal. Thank you again.

I realize this advice isn't generally popular on this site and runs counter to both of your stated objectives (quick and inexpensive) but I would suggest slowing down, travel multiple times to Asia, get to know her, build the relationship, and then decide on marriage after that. Immigration, of course, would come last.

Consider this, she and her daughter are going to want to return to her home country many times in the future. That's going to cost plenty. If she was always traveling alone it would be a huge expense, but you'll need to double all costs going forward. You might be better off doing some career building to be able to afford an international relationship than to speed head long into immigration.

No matter what course of action you take, I wish both of you good luck.

I have just one more question right now, IF I were to travel there,realize that this is what we want, then marry there,after all is said and done and she is allowed to enter the united states, would she also be responsible for returning back to Malaysia soon for another interview? I just got somewhat confused on this issue. And again thanks for all yur advice and opinions.

There is only one interview.. at the end of the spouse visa process (avg 10-12mos).. in her home country. She doesn't come to the US until she passes her interview and obtains a visa.

can't leave for a year? says who? of she gets a cr1 spouse visa she will have immediate green card and can leave any time she wants as long as she spends most of her time in the US. With a k'1 fiance visa she will be able to travel as soon as AP is granted which only takes a few months to receive after sending AOS

actually says that on USCIS account plus my brother in law bought in his Russian gf and her parents came for marriage

He bought tickets for them to all go on a curise for honeymoon and was told she could not leave the US for a year./ not even a cruise to the islands as that was leaving the US / that is what i go by
