Hi everybody! I would like to know your opinion about my situation. I am an italian citizen But I lost my ESTA after a j1 visa denial 2 years ago. One year ago ( beginning of october) I entered last time the US under a k1 visa but unfortunately things did not work out with my ex fiance and I came back to italy after 3 weeks. I would like to go to California for 2-3 weeks vacation in november and I am assuming I will not be able to have my esta anymore. What should I do? try to apply for a B tourist visa? Or it may be hard to get one at the embassy in italy because of my previous k1 visa?

I have my ties with italy ( my own business here, properties, family..)

Yes, check your ESTA first. That said, if you are still denied ESTA, I think your track history for visiting the USA and returning home with no overstays strengthens your chances of getting a tourist visa.

I think your travel history to the US and always returning home before the expiry of your status gives you a strong position in getting your visitor's visa, if your ESTA is denied.

When you go to your interview, just make sure you bring a lot of proof of ties to your home country. I would bring the deeds for your properties, as well as your income statements from your business.

Just be honest with the CO and try and engage with him/her on a human level. They're humans too, and they will hopefully understand that things happen in life sometimes, relationships break down, etc, but you have been 100% honest and law abiding. They will hopefully issue you a visa.

08/10/18 - Rec'd new NOA1 with 18 month extension instead of 12 months

10/15/18 - Case transferred to Nebraska

12/26/18 - ROC Approved
