My gf annulment is almost done. She just finished filing & finished at the local registrar where she was married. Now on to the next step, She now file at NSO to get her marriage null & void.

My question is;

1) does anyone know the timeframe to finish at NSO?

2) after NSO, is that the last step for her annulment?

3) how soon will be able to marry, so we can file for DCF?

Just want to know from your experience / knowledge, Thanks VJ.

My gf annulment is almost done. She just finished filing & finished at the local registrar where she was married.

Now on to the next step, She now file at NSO to get her marriage null & void. - This filing is for Annotation of her marriage Certificate. The marriage was declared null and void upon the court decision and issuance of Entry of Judgement.

My question is;

1) does anyone know the timeframe to finish at NSO? - you can never tell how long NSO can have the marriage contract annotated, it could be 4 weeks to 8 weeks depending where you are. I had mine updated in 2 weeks but I went to NSO main (Quezon City) to process it. So if you're fiancee is from the Visayas or Mindanao give it at least 4 weeks before checking if the marriage contract has been annotated at the local NSO office in her city/ town.

2) after NSO, is that the last step for her annulment? - the annulment case is done as soon as you have the Final Entry of Judgement. Don't confuse with the process. What you are doing now is just to update her marriage records with the PSA / NSO, they call it Marriage Contract Annotation. Then revert to her maiden name on all her records/ IDs/ Passport.

3) how soon will be able to marry, so we can file for DCF? - as soon as you can get a CENOMAR/ CENMAR you can apply for a marriage license.

CENOMAR

If an individual indeed contracted marriage, but was subsequently annulled, the CENOMAR shall reflect the said recorded marriage. The individual must produce the necessary documents that will prove the annulment as final and executory, and the said judgment reflected in the marriage certificate. (Certificate of Finality of the Judgment, Annotated Marriage Certificate issued by the NSO,etc). These documents must be annexed to the CENOMAR, for it to be accepted by the requesting authorities.

Here is how it works: (You might have done some of the steps that's ok... just walk through each step to completion)

1. Once you attain the divorce you will need the decision of the divorce (works also for an annulment), entry of judgment, then the decree of divorce (annulment).
2. Then you’ll need to secure copy of the marriage contract with the divorce (annulment) annotated on it. A total of four documents.
3. You’ll need to wait 20 days from receipt of the Solicitor General of copy of the decision before you can secure the Entry of Judgment.
4. After securing the Entry of Judgment, you will have to register the same to the Local Civil Registrar where the marriage took place or Filipino’s hometown. The said office will transmit the same to the NSO.
5. You will show the Court what date the LCR transmitted the documents to the NSO. With the proof of receipt of the NSO, the Court will then issue the Decree of Divorce (Annulment). After 15 days from receipt of the NSO of your documents, you can now request a copy of the marriage contract with the annotated divorce (annulment) proceedings. You need to request at least 4 certified copies for future use.

Upon filing at your local civil registrar, they send it to National NSO for encoding / scanning to the system. The system is connected to all NSO offices in the entire country; one system and they all have access to it. Therefore you don't have to go to NSO main to get an NSO copy of your papers (BC, MC, CEMAR/CENOMAR).

You will pay an LBC fee - it normally will take 5 working days for the papers to reach NSO main. Transmittal's are sent per batch, so they may tell you 1-3 months just to give enough time for shipping and encoding into the system.

Your papers will be available as soon as NSO main get's the documents and scanned it on the system. This time frame is unknown and all you can do is to check the local NSO periodically. Wait for a month and hopefully your local NSO will have it.

So pretty much; waiting for NSO, is to receive the CENOMAR / CEMAR, only then at that time (up to 2 months) then we can marry?

Right after marriage is their a waiting period, to file w/ the Embassy?

Can someone please clarify.

I'll clarify what I clarified. Those are the steps we took with a divorce and the same is true for an annulment. These are notes coming directly with someone who works for their local LCR and our own experience.

Can someone please clarify. - You can get your papers, annotated MS and CENOMAR from NSO. You can either go in person and get those papers or order online. yes, NSo system are all connected anywhere in the country. So as soon as your papers are in the system, you can get it from any NSO branch with a fee of course.

So pretty much; waiting for NSO, is to receive the CENOMAR / CEMAR, only then at that time (up to 2 months) then we can marry? - when the MC is available in the system with annotation of the annulment, then you can apply for CENOMAR at that same time. I am not sue it it will be really 2 months, you can check earlier is the MC is already annotated in the system.

Right after marriage is their a waiting period, to file w/ the Embassy? -after getting married, you register that with the local civil registrar and your MC will be forwarded to NSO, pretty much the same waiting period from getting the annulment recorded from Local civil registrar to NSO. When you have your MC on NSO paper, then you can now start filing with you DCF if you qualify.

There are long waiting periods here, be patient. This is just how the system works, like it or not - you have go to through it.

Can someone please clarify.

In short, just wait!

In the Philippines one will die before anything gets done :)

I am waiting on my MC now. The city hall said in two months... one left to go :) Ah... this is with advance endorsement too where you pay to expedite it ! It's smoking hot :)

Hi,

 

I hope someone here can shed some light on our situation. My fiance received the court decision of his annulment September 2017. It was filed March this year and brought afterwards to the LCR where they got married. We were informed that the documents were forwarded by the LCR to PSA end of June. The anotated MC & cenomar was supposed to be released last week. However, we were advised that it was declined by PSA due to the documents forwarded to them by LCR in Pampanga were not certified. I am not sure if this is a new policy or not. 

 

Question is, what do they mean that the documents were not certified?

 

How do we know that the docs are certified before LCR forwards them again to PSA?
