Domicile without a job - problems with NVC approval of AOS?

Hello!

So we've just got our case number from the NVC and paid the AOS bill, so we'll be ready to send in the AOS/IV soon enough. My wife (the USC) has the following for proving domicile:

- Lease for US address

- Various bills in her name at US address (electric, phone, bank)

- Driver's license

- Voter's registration card

What she's still working on is getting a US job. Since we have a joint sponsor who will be covering the financial part of the requirements, I'm not sure if this last one is necessary. I'm wondering if we can submit what we have to get the ball rolling. Will this be enough for the NVC to schedule an interview? At that stage she'll have a job so I could bring the evidence and show the consulate and hopefully get approved.

I'd rather send things in sooner than later, but don't want the AOS to be denied due to domicile.

Yes that is fine. You can take the offer letter at the interview. We had my in-laws sponsor us and we didn't have a place but our intended address for my in-laws. My husband gave his intention of domicile through bank statement, personal letter, etc. At the interview, consulate asked me if he had a job offer and he didn't. It didn't cause us any issues.

So in the end you still got the visa even though your husband didn't even have a job in the US? They didn't press you anymore about domicile? Did you bring proof of him trying to find work?

Hi Sean, yes I did. I took evidence of job submission from my husband but the officer didn't care but I would take it just in case they do choose to ask. Additionally, the problem I had was with I-864. This is what I had in terms of that: I-864 from my husband, I-864A from my in-laws. So essentially I was missing I-864 from my in laws so I was given a 221g for that so make sure your paperwork in that term is good. I think what you have is perfect. I didn't have any such thing as my husband was living with me in Canada so we only had a bank statement, a personalized letter from my husband stating the intent of living in the US and voter registration card. Good luck!
