Travelling without AP card, during AOS

Hi! My husband and I have a trip to Arizona next week, therefore we will be driving through Texas, New mexico and then into Arizona. Meaning, we will be hitting all this checkpoints where they ask for ID. My EAD AND AP card have been mailed but they probably won't arrive on time.

Last time i drove through the border myself (on work visa) they didn't even ask for ID and just looked at me and let me through but this time I will be nervous since I only have my foreign passport.

Should i just cancel the trip or do you think it will be ok?!

Hmm i think it was when i got to new mexico with my friends, we were stopped and they just inspected the car and let us through.

When they are busy, they just wave you through. But when they ask for your status / identity, just tell them you are AOS applicant, and show I-485 receipt, Driver License and you are good to go.

West bound: Las Cruces, NM

East bound: Sierra Blanca, TX

Ok thanks! If we manage to find a flight should I expect to have to show these these documents then too?

You shouldn't be asked for status when you fly domestic, only valid ID to get through TSA security. Don't know your destination, but here in Yuma AZ, you might be asked for status randomly by CBP before you board flight back. Tucson, Phoenix is cool though.

OP, do not (do NOT!) take inland CBP checkpoints lightly. With some exceptions during an experience of many years, I've found that the agents are generally in ill humor and are looking to nail somebody. Keep ALL your current documentation with you, including your marriage certificate and AOS letters.

Even U.S. citizens should avoid (like the plague) the internal CBP checkpoint south of Alpine, Texas.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

We are booking flights, it will be to Phoenix, plan on brining the i-481 NOA1, biometrics receipt and marriage certificate (my last name is the name as my husbands in my passport too). Sounds ok?

Yep - don't take them lightly, we asked a lawyer who recommends us flying because the border checkpoint workers on I-10 can be funny and it isn't worth the risk.

Been through a few of these myself, always been waved through. Seen them stop people a few times but never myself and my wife. I normally keep my AOS NOA1 on me just in case.

AoS Timeline:

PoE, Phoenix, AZ: 04-09-15

Marriage: 05-29-15

I485, I131 and 1765 Received at Chicago: 06-25-15

NoA date: 06-30-15

NoA received: 07-06-15

Biometrics letter received: 07-10-15

Biometrics appointment: 07-23-15

RFE: 07-24-15

RFE response received by USCIS: 07-29-15

EAD and AP approved: 09-16-15

EAD arrived: 09-23-15

AP arrived: 09-24-15

Interview: 12-7-15 [approved]

GC Received: 12-15-15
