We have received our packet 3 which is I need to start gathering documents for final interview and medical check. However, currently I am in states visiting my fiance and his family. It was a thrill for me to pass through the custom and we did not expect the packet will come this soon. During the POE, the CBP was saying they will withdraw my case or cancel my K1 application if I do not come back to my home country to process it. However, we do want to spend time together while gathering those information.

Would it be possible for CBP to withdraw our case from the embassy?

Also, if our K1 is expired as the NOA has stated, is it possible to still submit it to the local embassy to revalidate our case or reopen our case?

Please help!

Well, it is up to the CBP to allow you entry even with visa in hand, so if they tell you to return home and process your application. Don't sit there an dare them.

How long do you need to gather the information? It shouldn't take that long.... get it done and go home!

The CBP was telling you that your case will need you to be there for it in your country in order to finish the process and receive your K-1 visa.

Contact your consulate about getting your petition's validity extended. Many will do this automatically, but contact them to make sure they will do it and need nothing else from you in order to do so.

It does not take long to fill out the DS-160 and get the financial documents needed from the USC petitioner. You need to return and get your police certificates, have your medical and attend a K-1 visa interview.
