We are cutting it super close to our RFE deadline and I'm nervous. Part of the reason was because the USCIS is STILL sending mail to our old address though we've filed for a change of address...twice!

The RFE instructs us to "...send the requested documents to the following address within 30 days..."

That date is September 27th. So do we meet the deadline if the letter is post marked before September 27th? Or do we meet the deadline if the USCIS receives it by the 27th? What constitutes meeting the deadline in this situation - when the letter was postmarked, or when it was received?

Please say postmarked.

Also, can I send via overnight once we get all the materials?

The address is:

26 Federal Plaza Room 8-800

New York, NY 10278

Doesn't seem like a PO Box, so overnight mail should be fine? Or does anyone recommend another type of express mail? I know US Express / Priority are other options.

How much left do you have to do before sending in the RFE? Why not try to get it out the door ASAP and have it there before the 27th instead of taking a gamble and sending it out the same day the deadline is? Which you can't anyway because the 27th is a Sunday.

I would if we had everything. We had to do the i693 again and are waiting on the X-Rays for the form to be complete. Should be today, maybe tomorrow.

How about overnighting? Is this possible?

Also - does anyone know if the deadline is considered satisfied by the postmarked date or the received date? It says "please send by..." So that implies postmarked but I don't really trust that.

Just to rant a little...

It's kind of a silly rfe anyway. She's been in the country without an i131 (no international travel), and there hasn't been an infectious disease outbreak in our area. I thought the logical purpose of the i693 was to prevent things like TB (or whatever) from entering the country and making sure the vaccine schedule matches the requirements here. It's not like she's 'less' vaccinated since living here, and she doesn't pose a public health risk any more or less than anyone else living in our city for the past 10 months. So bizarre.
