I 134 sponsorship question!!

Hello,

My fiancé and I have received our NOA2 and we are just looking at the requirements for the next stage.

We were wondering, with the i 134 affidavit, would his student financial aid count towards his earnings to add up to the 125% over the poverty guideline? Does financial aid count as a form of income, or is it solely from him job?

Thank you! Can i just confirm, you said co-sponsor: does that mean we can have someone cover the remainder of his salary which doesnt reach the 125 (so two sponsors), or do we need someone to cover the entire 125% amount?

The Co-Sponsor would need to meet the 125% for their own household size plus the intending immigrant. :) Good luck!

Just to clarify, no the co sponsor can not only make up the remainder unfortunately.

So for example, if the cosponsor is single, they would have to make 19.912$. That is what it needed for a household of two, in this case it would be the cosponsor and your fiance.

If the cosponsor has a child, then the household would become three, the cosponsor, the child, and your fiance.

Household essentially is, the cosponsor, any people who are financially dependant on that person, and your fiance.

So I'm either married or have had to leave usa. Then when we submit i 864; for adjustment of status my then husband can sponsor me and we can get a co sponsor to make up the difference in salary requirements (he earns about 100, 110%) to take us to 125%?

Joint sponsor for the I 864 needs to make the full requirement, not just top up.

London only requires 100% with the I-134 for the K-1. So, if the USC petitioner makes 100-110%, then you won't need a co-sponsor.

After you are married and need the I-864 for AOS, then you are required to have 125%. If you don't meet the income requirement, then you can make up the difference in assets, calculated at 3 times the amount you are short. If using a joint sponsor, they need to meet the entire 125% requirement for their own household size plus the intending immigrant. If the USC petitioner/sponsor resides with any qualifying household members(such as parents or siblings), then those household members can fill out an I-864A to add their incomes to the sponsor's on their I-864 to reach the requirement together. Read through the I-864 instructions for all the details on assets, joint sponsors and qualifying household members.
