AOS is pending at Houston Field Office over 4 months - no news

Hi,

I sent my AOS packet almost 4 months but now still no news from Houston local office. I checked the Houston time frame - it shows Jan 10th 2015 - which means I have to wait at least 5 more months to get interview? However, I see USCIS website confirm that they will make the decision within 6 months. I am confusing now. Which one is correct? Time frame or USCIS confirm 6 months is correct?.

On 31st July, Houston was processing I-485s filed on or before 10th January. Assuming a linear progression (rarely the case, but gives you a ballpark) you have another 4-5 months of waiting.

There's a very real chance that your application isn't at the Houston office. It's probably still in Missouri where all of the AOS applications start. There's also the chance that you'll receive an NPIW (notice of potential interview waiver) letter and that it will never go to Houston at all. If that happens the letter says that from the date of the letter there will be an additional six months wait. We filed in February and got our letter in June. I'd done some research and found most folks who received the letter got it 4 months after filing. But some got it earlier and some got it later. My local office was working on January 12, 2015 at the end of July. In theory, I should be getting a notice any day now about my interview being scheduled. But I'm doubtful. I'm just hoping that the green card will be here by Christmas... just over 6 months after we received our NPIW. I am hoping the best for you and that the process is faster but wanted to let you know that four to five months might be the best case. Good luck

If you call USCIS' misinformation line and ask to speak to a tier 2 officer (i.e. a real USCIS officer) they can tell you where your application is currently pending.

• Received a notice from us about your case,
• Responded to a request for evidence, OR
• Received an online update to your case status.

If your application type is not listed in the processing time table on our website, our goal is to make a decision on your application within 6 months of filing. Please wait six months before submitting an inquiry

I agreed with your opinions. I will call USCIS on next Monday to make sure where is my case is Houston or Missouri. However, my case was showed ready to schedule for interview since July 9th then I thought it was sent to Houston - but we never know what happened - should call to make sure. About NPIW, I read some thread and agree that most people getting their NPIW within 4 months and most cases were approve within 2-3 months instead of 6 months that they mentioned in the letter. Hope you het your approval soon bro.

Answer:

Once the Houston District receives the file, expect to hear from the Houston District within 120 days. If you have not heard from the Houston District within 120 days, submit an email inquiry to: hou.inquiries.uscis.dhs.gov.

If this is the case that means theres a problem with my case because i havent received any update since april 20th for i485 which is fingerprint fee received.

Very interesting. I do not even know where my case is at, if its at nbc or houston field office. Meanwhile customer care wont transfer me to an immigration office to find out. This is just........

I didn't realize that you'd received the "ready to schedule an interview" update. That's a whole new can of worms. You're right, it should be in Houston then. I wonder if the 120 day clock starts with that status update. But it's definitely worth a phone call or an email. Good luck!
