I'm from South Africa and am studying for my masters in New York. I first came for a summer course and had my visa for the duration of that course, and was told I could transfer my SEVIS to the new school within 90 days before the next course started. Unfortunately I just found out it's only a 60 day deadline to transfer it, and I have now overstayed by about 10 days. I got the new i-20 form for the new school (which is starting in about 10 days) and was told to reapply for a new visa, so I am flying back to South Africa immediately to reapply. How will this overstay affect my chances of getting a new visa? If I get it, will it still show up when I re-enter the US? Is it totally necessary for me to leave the US to reapply for the visa or can I speak to an immigration lawyer and get something figured out here to transfer?

I would imagine if you have a strong enough case except for this issue it should not be a problem, no ban after all.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
