i-212 permission to reapply for admission waiver [merged threads]

I wanted to know if anyone here has applied for the i-212 waiver and was approved? My husband was found ineligible for a visa under sections 212(a)(9)(B)(i)(II) and 212(a)(9)©(i)(II) . In January he has completed 10 years living in his home country, outside of the USA. I currently have an i-130 petition at the Texas Service Center waiting on approval. I am aware that he will need to file the i-212 waiver. After the waiver is sent in and accepted what is the average time it takes to get an approval? The other point I was wondering is when I contacted the embassy where he add his first interview in 2006, I asked for info on his case because over the years I lost the paper they had given him when he was denied a visa. the info they sent me was correct all except for the date they have on record of his departure from the US. They have that he left in January of 2005 but he left in January of 2006. Is that going to be a problem? I asked my husband and he assures me he told them 2006, but maybe they understood him wrong.

Many people have been approved for the I-212 waiver! It seems to be taking 5-7 months for it. We're about 3 1/2 months into waiting for my husband's I-601/I-212 waivers to get approved.

Lone I 212 is filed in the jurisdiction the person left from & take 2-12 mths to get decision

Just be sure that he gather proof he been in his country all this time & stayed out, with pay stubs,

leases, medical appointments, banking transactions,certified church membership etc also

address and correct these dates upfront as their mistakes

ok thank you. I have lots of proof of him being in his country all this time. I am just really worried about the wrong year they have on file. And I am not sure on how to go about fixing it and not making any problems for my Husbands visa this time. We have waited all these years for this day to come and I just want everything to go the way it should.

Just point it out as a seeming error...don't let it stay then he gets

I was wondering if my Husband can file the i-212 before he has his interview at the embassy, that way he already has his approval when he attends? Or will he have to wait until after his interview? He was found ineligible at an interview in 2006. We are aware that he will need to file the waiver. Just wanted to get a head start. Thanks for any info.

Will he need a 601 waiver as well?

Typically no, it has to be requested for at the interview

So how would I go about informing them? Would my husband bring it up at his interview, when we file his i-212, or do I contact the Embassy? I just want to do things right, I know that they are very strict and check everything.

He shouldn't need the i-601 because he has spent 10 years out of the US. Ok Thank you. I was hoping he could file it before that way we would not have to wait additional time. After all we have waited 10 years, plus however long the i-130 process will take. I imagine 1 more year and THEN file the i-212. Wow I just want to have him back in the States with his family.

Ok thank you. When your Husband was denied I assume it was at Ciudad Juarez. How did they tell him about filing the waivers? Like what instructions? I am pretty sure my Husband will not have to file the i-601 because he has been out of the US for 10 years, but he will have to file the i-212 because he was found inadmissible under 212(a)(9)©(i)(II) for EWI after removal. Thanks

They just said that they couldn't give him his visa, and that he would need to submit the I-601 and I-212 waivers in order to pardon his illegal entry and deportation. Then he got a blue sheet that checked both boxes next to I-601 and I-212. They don't really tell you how to go about filing, what it needs to say, where you send it, etc. That stuff you get from the forms.
