Makes you wonder what he said was the purpose of his visit, presumably not to visit you.

conference attenedance. I vaguely remember him talking about attending a conference during that time but I didn't know that he had applied, misrepresented, and interviewed. I remember him telling me that he was going to Kano, and when i called his mother during that "trip to Kano" she was thanking me for getting him an interview. I didn't put two and two together until the revelation of all this.

When someone said that you wrote on your bio that you two met in ghana...etc. I looked at your story and it says you met him on Zoosk. Was he upfront with you when you met him on that site, as in did he tell you right away that he lived in Nigeria? You cant sign up to Zoosk saying you are in Nigeria or Ghana. In fact, to even get on the site from those countries you'd have to be using an IP changer to hide your location. I'm not asking this trying to elicit an answer that you have to share with everyone here. Just trying to make a point that maybe you should look back at your history with him and see if there has been any other flags. That might help you make your decision of what to do.

when we met on zoosk he was in china at school. He left china when I explained to him that without money to register for the next term that he would be in china overstaying a visa and that will not look good. So he left china and came back to Nigeria.

I could tell when I clicked on his photo that he was African. So I initiated contact with him becaue I assumed that because I was Black that he would think that I wouldn't be interested in an African.

So he wasn't in Nigeria when we met. Verified China.

I have heard it over and over again that to show strong ties, sub-saharan applicants have used the wife/fiance/child lie for a B2.

That is common street advice and a second K1 or CR1 filing will not help because he will be hit with misrepresentation.

I know of 2 cases where this happened personally.

In order to have a chance of approval a waiver needs to be filed. You need to consult a lawyer on how to draft a hardship letter as it is a very

difficult thing to do if you chose to go on with this. Usually waiver forms are handed out at the interview when the visa is refused.

You can request a FOIA for consular notes but you both have to sign the release forms or they will not answer things pertaining to him due to privacy laws.

What would concern me more than anything is that he was not transparent with you and like so many others thinks he can just squeeze by

without telling you and that is a huge red flag for your future. It shows carelessness, secrecy and disrespect for all your time wasted not

to mention the expense.

What he said the CO said doesn't make sense to me, especially in a tough embassy like Lagos.

A FOIA could reveal that perhaps.

The couple I know (beneficiary is Nigerian) had the same situation, she married him and filed a CR1 after a returned K1 and got denied

again due to the same misrepresentation; she had enough and left him.

I would cut my losses and end it, he had a choice and made the wrong one not telling you and that carries consequences.

Believe me when I tell you this behavior doesn't stop once he would make it here.

He could make your life a living hell with secrecy doing what he wants and leave you in the dark. Lies like these are not a good foundation

to build a marriage on.

A FOIA request will not get the consular notes. They are classified confidential.By the time they are received, they will be so heavily redacted that they will be worthless.

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Interesting I have not seen this, any examples, just wondered what others had been able to obtain.

COnfidential is a level of classification. I only expect to get whether the notes were favorable or unfavorable from my congressman. I won't get the entire cover sheet that goes along with the revocation. That would be way to easy. lol

9 FAM appendix E refers the agent to 9 FAM 40,4 so doing a FOIA request will cost a person 30 lost calendar days to get nothing worthwhile back

There are not confidential in the terms that the government commonly uses the words secret or confidential. ( there is nothing to create a derivative classification from but as a GS 13 I assume you are already aware of this )

The problem with some people drafting FOIA requests is that they request consular notes from USCIS when they need to be requested from DOS.

As a courtesy USCIS sometimes forwards requests to DOS and send the petitioner blank pages who then wonders why.

Sometimes it warrants consulting an attorney who is experienced in requesting consular notes.

FOIA can take 8 weeks or a year or 6 months, they are all over the place with that.

But my point is in a well prepared request with both, the petitioner and especially the beneficiary signing the privacy release or else it's not

happening. Very specific requests are the key.
In the links above it says that they do release confidential information if a release signature is there from the person who the info is sought about.

No, there aren't any guarantees but it may be worth a shot. Then again it may not be.....but why not try.

I am intrigued, must be sleep walking, maybe my brain cells have finally given up, just do not recollect anybody reporting back on notes obtained about the Consulate interview. Anybody have a link to a thread where this was achieved.

Sorry to hear about the denial, so you guys knew each other when he applied for his business visa, and he never brought up the fact? That could seem questionable to the cos, have you met his family, I.e mother father brothers sisters?
