Hi VJ members,

My wife interview date for F2A visa will be few months before the birth of our child , I have read in many places that the new porn baby will not need a new visa petition and he/she can accompany the parent and will be processed at POE , is there any one familiar with the process for such case and how the airline will allow the baby to travel ?.

The baby will need a passport or visa to enter the US. If one of the parents is a USC, then you can file a CRBA in the country the child was born and also apply for a passport at that time. Otherwise, you will need to get a Visa and then "Americanize" the baby once he's here if one of the parents is a USC,

If the baby is born after the mother's immigrant visa is issued, and the baby goes to the US at the same time as the mother, the baby does not need a visa to enter the US, and will be a permanent resident just like as if he/she had an immigrant visa. See 9 FAM 42.1 N1.1(1)

The child born after the issuance of a visa to a parent is not required to have a visa if the child is:
(1) Born subsequent to issuance of an IV to the accompanying parent within the validity of the parent’s immigrant visa

In such a case, although the US doesn't require anything for the baby, you may want to get a transportation letter from the US consulate that indicates that the baby can enter the US for the purposes of satisfying the airline and/or the departing country's exit checks.
