Hello admin and members, I was clueless of what to do next after my 74 years old mom who was granted a multiple entry visa as a tourist in the united states was REVOKED because she was overstayed for 1 day. My agent booked her flight and we followed of what the ticket said and i didn't calculated the length of stay. I didn't care to look at the ticket because of too much excitement to see her again. I haven't seen her for 5 years since i left in the Philippines. On her 1st visit she was overstayed for 1day and when she visit the 2nd time she only stay here with me for 3 months and this is the time that they gave her a waiver in the 2nd visit but when I check her visa there wasn't REVOKED mark on it and so I assumed that it was okay to get her another ticket to fly back here after of 5 months stay in the Philippines and so what happened on her 3rd visit last month she didn't get admitted in the United States. So, I learn my lesson. Anyway, I am an American Citizen can i file her an immigrant visa right away after her tourist visa was revoked? Or should i wait for a year and a half to two years to file her an I-130 parents visa? Is there a bar for 1 day overstayed? And if there is a bar how many years before I can apply her for a parent visa? Please be advised. Thank you.

You can file right away- it's a different visa, and the one day overstay will not create a an for the tourist visa.

Be aware that you may be asked not only for the normal I-864, but also evidence that you can pay for your mom's medical costs, as she is elderly and likely won;t be able to work.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
