Received my RFE mail...it states:

Submit all supporting tax documentation(W-2s,1099s,Form 2555,and all supporting tax schedules)submitted to the internal revenue service for the most recent tax year. The petitioner/sponsor's household member must submit all supporting tax documents for the most recent tax year.

What should I send here..and does it center only on the petitioner's household member?

I would send both petitioner's and the sponsor's information to avoid more delay.

Didnt you send the tax documents originally? (or did you send the IRS certified tax return)?

I sent the IRS transcript for both the petitioner and the petitioner's household member. Is the RFE asking for just the petitioner's household member tax documentations?

Is the household member married and files jointly with their spouse? If so, that is why they are asking for all the forms, schedules and W-2s and/or 1099s. They need to see the household member's individual income from the tax return. They cannot see that through an IRS transcript for a joint filing.

Is the household member married and files jointly with their spouse? If so, that is why they are asking for all the forms, schedules and W-2s and/or 1099s. Thanks for the reply...The household member is single and she filed alone. So I should send the household member's W-2s and 1040 Edited by judefabulous

Hmm, I wonder if they just overlooked the transcript from the household member then. Just send the copy of the return with all forms, schedules, W-2s and/or 1099s like they are requesting.

Thanks alot..I will send the household member's most recent 1040s with W-2s and 6 month pay stub to show her current pay. Do I have to send any of the petitioner's tax documents?

You must submit a COMPLETE tax return to show you filed taxes and they look at your adjusted gross income to see if it is above the 125% of the poverty level. You have two options for providing the USCIS a COMPLETE tax return: 1) submit the 1040 version your are required to file--i.e. 1040, 104A, 1040EZ--and ALL supporting documentations which includes W-2s, 1099s, schedules, etc, or 2) you can order tax transcripts from the IRS and submit those as a COMPLETE tax return.

You only need to supply exactly what the RFE asks for. If it is asking for only the household member's tax return, then that is all you need to send in.
