Hi All,

My wife has applied for her parents for immigration visas (I130). She filed separate applications (Form I130) for her father and mother and they got approved at the same time. She does not work. So I am filing I864A along with her I864. Below are my questions;

1. We paid AOS fee $120 for one parent and looks likes it was applied to other parent too. Does she need to file separte I864 for each parent as well? If yes, how to answer to question 2 in Part 3? While mother is a principal immigrant, is father to be considered as a family member who would be immigrating with the principal immigrant?

1.Would putting zero as her individual income disqualify her to be the petitioner? (Please refer Form I864, Part 2, Question 2)

yes

Don't check that box. That is for family members immigrating on the same petition. Each of her parents is petitioned on a separate petition.

(You mean Part 6 question 2?) No.

1. Should she check yes in 18a?

Yes, if she filed a tax return for each of those 3 years.

2. Should she put my gross income in 19 (even her income was none)

She should put exactly the number it says on the "total income" line on the tax returns for those years.
