I am wondering if anyone knows what information comes from the FBI name check if the applicant has no criminal background.

Does the INS adjuster get a history of all previous addresses to compare with the addresses the applicant supplied on the G-325A biographic information form?

Is that part of the purpose of the FBI check or is it strictly to weed out the criminals?

Just curious...thanks!

FBI name check comes back to USCIS looking like this:

[ ] EVIL

[X] NOT EVIL

I kid of course, however most people if they haven't had any trouble with the law, and *most importantly* don't have a name similar to someone who's had trouble with the law, will have no entry on the FBI database. FBI doesn't track where you live. ;)

They are comparing your name to a very large list of criminals and known terrorists from around the world... if you are unlucky to have the same name as someone on the list it can take a very long time to get things sorted out.... people here have been waiting years to clear FBI namecheck...

When your a k-1 or a K-3 I think its funny how they then do the FBI namecheck...didn't they do a name check BEFORE you got the visa anyway?!

Just kinda amuses me :P

107 days from mailing AOS package to receiving green card! Received 6/27/07 dated 6/20/07

Removing conditions:

Check cashed 5/27/09

NOA date 5/26/09 - still not received

I-551 stamp in passport 6/19/09

Biometrics notice date 6/16/09

They are comparing your name to a very large list of criminals and known terrorists from around the world... if you are unlucky to have the same name as someone on the list it can take a very long time to get things sorted out.... people here have been waiting years to clear FBI namecheck...

They also check you name and all of it permutations against suspected incidents. Due to the fact that they have not computerized yet, most of these "hits" must be checked manually. There is a new system that is putting there entire archive on their computer system which should (lol) reduce the time for these. That is unless you really are a bad person.

I guess that any additional namecheck implies that the previous ones were worthless ;)

I am not aware of what information returns from a name check but it appears that some computer systems needs to be linked together. Shall we write a program and offer this to them?

11/13/2006 - Filing Date.

11/20/2006 - NOA date for I-485.

02/01/2007 - I-485 Biometrics Appt Date.

03/15/2007 - Interview Date.

04/04/2007 - (Info Pass) Pending - name check.

05/xx/2007 - Phone Call to NSC - name check returned.

06/04/2007 - (CRIS) Notice mailed welcoming new permanent resident.

06/04/2007 - (USCIS) Welcome to USA letter received 10 Year PRC K-1 & k-2.

06/05/2007 - (USCIS) Card production ordered.

06/11/2007 - (USCIS) 10 Year PRC received K-1 & k-2.

03/11/2010 - File for Citizenship

04/02/2012 - N-400 mailed via carrier

09/21/2012 - Oath Los Angeles - United State Citizen

AOS approved (start to finish) 7 months.

AOS approved 2 months and 20 days after AOS Interview (was in FBI name check).

That cracked me up!!!

Hopefully my name is unique enough to not get confused with any evildoers. It sounds like the process is a bit of a mess. I hope my name doesn't get stuck like so many people here. Thanks to all for your replies!

there are some namechecks prior to visa issuance for certain people - but its not called fbi namecheck - its called Visa Mantis. really most countries rely on the police reports in order to gage an approval for a visa. this is just part of the process stateside to adjust or naturalize.

I still think that it proves that any previous checks were either worthless or inadequate.

Seriously, the entire namechecks procedure is illogical, inconvenient and unfair. Does AOS make a bad guy any more dangerous? Nope. Entry to the US does. Once a person if physically present in the US, it does not make any difference if he is a LPR or not. Doing any of the following:

- adjusting status without waiting for namecheck results, but cancelling his residency if FBI reports that he is a "bad guy",

- waiting for namecheck results and then making his residency retroactive to the interview date,

would be much more fair and would not in any way compromise the US security.

Then, maybe we should keep quiet about it. The problem may be "solved" by making K-1 applicants wait for the "real" namecheck results before the visa is issued...

what do you mean? the US already *categorizes* those they wish to have security clearances prior to visa issuance based on the "list of 26" countries with terrorism ties. The government seems to be satisfied with receiving local police reports to anyone else for non-immigrant visas. THEN you add in an adjustment of status, and yes, its a whole new ballgame.

Its what I still wondering too. Because before I came, I had name checks twice already. First when he sent in I-129, and second when I had my visa interview. I just would really have to try very hard during few months get in troubles since I am here what could be interesting for FBI. Its all so silly. But they make rules, and we just play along. I even got for me extra police statement that I have not had in crimes in my country, just in case...

07/29/2006 – I-129 sent to Vermont

08/04/2006 - NOA1

08/28/2006 - NOA2 - approved

09/01/2006 - NVC - approved

09/07/2006 - Warsaw embassy sent packet 3 (damn post services, never received any)

I was not aware of that. But it does not really change my opinion about the process - if those applicants are so carefully screened before entry, then why subject them to namechecks again?

Yep, an extremely unfair ballgame. BTW, I had no problems with the namecheck, and even if I had, it would have been a mere inconvenience (getting new AP's and EADs). I am pis*ed off on behalf of others ;) For some people getting GC as soon as possible is very important, for example to naturalize quicker and be able to sponsor a parent.

In reading the Ombudsman's Report, he specifically addresses this issue and talks about how illogical it is to give interim benefits to a person who potentially could be denied immigration

Can you see a huge potential of a wrong problem being solved? ;)

because when overseas you are subject to VISA rules (DOS rules) and stateside for AOS/naturalization benefits you are subject to DHS rules. In our case we did have 7 or so months of administrative review to determine my arab husband wasn't a *bad* guy... now we are over a year in namechecks because he AOS'ed... yes, its foul.
