Address Question on Visa Application

Hello all,

I am currently in the process of filling out and eventually submitting the K-1 fiance visa for fiance from the UK.

I have run into a bit of a snag, as I currently have more than one address in a sense.

I am a college student and during the week days I live at address A, and on weekends address B, which is my parents house.

I am trying to determine which address I should list for the visa.

For address A, I have the following ties:

-this is the address the USPS has listed for me and I receive most of my mail.

-this is the address I listed when applying for health insurance.

For address B I have these:

-This is the address I have on my drivers license. I never filed for an address change so I am assuming it is still active through the DMV

-This is the address I use to vote/where I am registered to vote through.

-This is the address where I receive bank statements from.

-This is the addressed used for W2/Tax return/other irs/tax processes.

If it is possible to use either, I would much rather prefer to use address B. The reason for this is related to the Affidavit of support (the I-864 version I will need to fill out when he adjusts status). As I mentioned earlier I am a college student. I work part time and have enough to sustain myself but I do not meet the 125% poverty threshold criteria. However, both of my parents are very on board with this process and would have no qualms with me listing their incomes in the household income category which would put me plenty above the 125%.

Ideally I would just like to list address B on the applications and not mention address A at all. (I am 90% did so for my passport which I recently applied for it and no red flags were raised). I am worried about legal ramifications of this though and whether or not it has the potential to result in a denial of the visa application.

Any advice is VERY much appreciated. I am currently trying to take most of this on on my own and it has been quite overwhelming!

Timeline

Home address (with paretns) always as this is the one on your ID as in this case your driving license.

and your college address can change from year to year. it is not your stationary address.

this is the addres you will use for passport

Are you talking about filing the I-129F petition with USCIS, or the visa application for the London embassy? This is unclear.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes, sorry. The I-129F and then the corresponding G-325a I need to submit with it.

But I am assuming that I should put the same address for both this and the visa application for the London Embassy, correct?

The part that is going to get you is that on the G325 it asks for all of your addresses in the last five years, you're going to want to list ALL dresses. The government knows the addresses you have things sent too, especially if you have your health insurance registered to your school address. You're going to need to list your school address on the G325A, I'm just not sure how you're suppose to because you're currently living there too. Personally, if you're only staying somewhere two days out of the week, it's shouldn't be considered your primary address.

You seem to only be saying you live at your parents house so when you do the I-864 for AOS you can include them on the household income. It's a slippery slope since you only spend the weekends at your parents house.

Could you stay at your school over the weekend? If so, then really you're just a visitor in your parents house every weekend.

I'd be careful.

Could you just use your parents as cosponsors and joint sponsors? Are they going to co-sponsor for K1, because you can't combine income for K1? Most consulates also use the 125% when judging (even though they don't have to) because it's a NIV with intent to immigrate, meaning they know that you'll have to meet that 125% in a month or two after marriage.

Yes I was thinking about possibly listing the address A on my G325 but possibly add a note in there that it is a temporary address or even just a mailing address. The thing is at the point in time when my fiancé needs to go in for his interview I am most likely going to have moved back to address B for good (as I am graduating). It is also the address I am using as we are going to be living there together indefinitely until either of us find new jobs or an apartment somewhere else.

Like I mentioned in the OP when I applied for a passport I used address B as my permanent residents and there was no issue. I understand that they government will do a much more thorough investigation for the fiance application than they did for the passport, but most records are going to list B ad my address.

Also when I provide bank statements and W2 forms address B is going to be on all of them because that is where I am residing according to their records. I feel like listing address A as my main residence and then having conflicting documents may be more of an issue then just the post office records. I feel like I can claim it as a mailing address, and from what I understand it's perfectly legal and not abnormal to have a mailing address different than your registered address. Especially if these addresses are nearby each other within the same state. I could just be being naive and optimistic about it, and if I am not confident with my decision at the time of filing I will contact an attorney.

As for the AOS issue, I am aware there is no line for additional/household income in the version that goes along with the K-1. My father has agreed to fill out a separate form and list himself as a joint sponsor for that step.

I could just scrap all this and use him as a joint sponsor for both, yes, and avoid the household income route, but I was informed that the household income holds more legal support than a joint sponsor, and that visas/adjustment of status have been denied regularly because even if the joint sponsor more than makes up for the diffrence, it's not easy to hold them responsible. That could be bad information, I'm not sure but even if it is I still run into the issues I mentioned above where my w2, bank statements, and now that I think of it even my pay stubs will be addressed to address B.
