I have our K-1 interview in a month. My fiance and I already have two kids together. I have another child, now 16, with another man. He hasn't seen his dad in 6 years and hes a drug addict, I have no idea how to find him. But the separation agreement with him from 6 years ago says the dad needs to be notified before I can move out of the province, Ontario.

The 16 year old has a different last name than me, so I imagine the interviewer will ask about that, but do I have to mention anything about the separate agreement? Will they have that information?

Thanks. We are so close to having a better life and I would be beside myself if his dead beat dad somehow manages to mess it up.

May want to consider making a public notification in a newspaper regarding the requirement of notification in your separation agreement. I know they do that in divorce and adoption cases when the other party cannot be located.

If you are asked in the interview, then just tell the truth.

If you cannot locate him, research into this, as not sure if you would need an attorney and go to court. You may wanna do this asap, so you can take the clippings and all proof related to this to your interview.

At 16 I think in the UK he does not need permission, what is the age in Canada?

If it's in the separation agreement, won't they already have that because you have to provide your divorce paperwork to prove that you're free to marry again? Better to tell the truth than be caught in a lie if they already know about it...

12/17/14 - IV Fee invoiced

1/5/15 - USPS delivered packages to NVC

1/7/15 - NVC scanned in packages. Let the countdown begin...

1/30/15 - FINALLY got a reply to my email to remove the attorney from the DS-261

3/9/15 - Called NVC and they have checklisted us for an "incorrect" decree absolute from the UK, even though it is the legal official document. Have requested a supervisor review.

4/28/15 - Called and NVC said supervisor had reviewed and now claimed that the decree absolute was not included. After disagreeing with the less than helpful lady on the phone, and her not being able to get the review time right. (She kept changing her story between 42 days and 30 days).

4/30/15 - Sent the same copy of the decree absolute to the NVC from the UK, highlighting the "decree absolute" wording with a letter stating that this is the only document provided by the UK government.

5/6/15 - Scan date for checklist received.

6/5/15 - Case complete!!!

6/12/15 - Called and interview is scheduled for July 1!

6/14/15 - Received email with interview date and instructions.

6/19/15 - Case showing as ready on CEAC.

7/1/15 - Approved at interview!!!

7/6/15 - CEAC changed to Administrative Processing

7/7/15 - CEAC changed to Issued!!!!!

7/10/15 - Passport and packet delivered!

7/29/15 - Husband entered with visa at Dallas/Fort Worth airport

9/29/15 - GC delivered!!!

5/4/17 - ROC packet sent via USPS

5/9/17 - Tracking shows delivered

5/17/17 - Check cashed

5/19/17 - NOA1 received with date of 5/8/17

5/27/17 - Biometrics appt received 6/8/17

I think it is pretty standard during a K-1/2 interview to ask if you have permission from the child's other parent. Even if they don't ask and you don't obtain the permission you are required to obtain what happens if dad or one of dad's relatives notices the child is missing? You could be facing jail, lots of court, and international kidnapping charges.

I have a simular issue. You will need to show some kind of court document at the interview to prove you can relocate with the child, either a sole parental court order, or a letter from the court granting permission for the child to move or a signed notarized letter from the father.

If you can not locate the father you have to show the court that you have tried. I would suggest you try and find him yourself as going through the courts is a long and costly process (as you probably know). I had my lawyer send my ex the paper work to obtain the notarized letter.

Thanks everyone. Our court order doesn't say we need his fathers permission. It says the child, who is 16, can decide where he wants to live and with whom. But it does say we need to notify the father of our intent to move.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes, it will come up in the interview. For immigration purposes, at certain embassies, it is a requirement to have some documentation from the other parent that they have been notified and approve of the intent to immigrate to the US.

My son was 17 when we immigrated. His father had NOTHING to do with him his entire life. He was ordered to pay child support (never recieved a dime), never called, sent cards/gifts, nothing.

Yet because my original divorce/custody agreement had wording to the effect of "Father gets reasonable access at reasonable times" (or something like that) the interviewer wanted me to get a legal paper stating that my son could live outside Canada.

Sooo, I had to prove to the court I had looked for him. I had to show a newspaper ad I had placed in the last city I knew he had lived in, I brought facebook searches to show I couldn't find him, etc. THEN I had to go to family court and get his rights revoked so that I had the legal right to make the decision on where my son lived. It took a little over 6 months (from start to finish). Once I presented those court docs to Montreal, my visa was issued.

It sucked but I'm glad I got it done and over with.
