Technically no, but a really good idea to send it in by then.

There is no deadline to file the AOS package from a K1. Your only deadline is to get married within 90 days of entry into the U.S. Most people file soon after marriage, but others take more time for various reasons ( not able to cover fees, need a co-sponsor for the I864, etc.) If you you can afford it and don't need a co-sponsor, it is suggested to file soon after marriage since your spouse is considered out-of-status until you do. This doesn't mean they will be deported, but it does place limits on travel, and can lead to headaches if they are ever brought in to prove their right to be in the U.S.

Regardless of what you do, Good Luck!

We are in the process of sorting our I-485 as well and I see you/your spouse are Czech...how did you handle the translation of Czech birth certificate? Did you simply just get court appointed translator to have the copy translated or did you also get the copy first certified by a notary and apostille attached from the Ministry of justice?

Thank you!

Hi,

we also got apostille attached from the Ministry of justice, after all certified translator managed birth certificate translation including one more certified copy.

Good luck!

Hi Radka,

Thanks a lot for your reply! One more thing - was the certified translation done in the US or CZ? Also did you skip the notary altogether?

Thanks so much again!

Eva

Hi Eva,

I did it in Czech Republic, translation agency managed notary as a part of the deal. They do it on daily basic.

I'm not sure you will be able to do it in the USA.

Call to your "matrika" and ask them what to do to get certified copy in the reason of marriage to United States. They will tell you exactly where to go in Prague. :)

But you can do translation after all certification and that is what you do personally.
