Could they file for K1 again or can they only do that once? Might be faster than spousal?!

That's not a bad idea. They could, but the marriage visa may suggest that they are more serious. Either way, they could get denied again. The only thing is that if they re-file for a K-1, they won't be able to do anything again and waste more time. If they marry and do a CR-1, then they will have an appeal option.

I have a friend who was 47 and her husband was 26 when he came to the USA on a K1 in 2013. They were worried about the age difference, but the consulate didn't even address that issue. The one issue he had a problem with was, the fiancé only had a 7th grade education, and she was highly educated, which made them seem unmatched. They did get the visa though.

There must be more to the consulates concerns than simply the age gap.

Your case is a hard one. You two have almost a lifetime age difference. So now the next step is to try to ask them to reconsider and start making marriage plans for a different manner and applying again. I don't know what other evidence you had, but you may need to make it stronger. By then, however, you will probably have more evidence of your relationship too.

it is discrimination to deny a visa based on age alone. I am 21 years older than my husband and we had no issues whatsoever at any ppoint in his journey, he just applied for citizenship.

OP did you must not have had enough evidence to prove a bonafide relationship

Have your fiance contact his senator to request a second interview as soon as possible.

Have him approach it from the angle of age discrimination and that your relationship evidence was not looked at.

If granted a second interview your fiance needs to be there with more evidence that addresses the age gap.

If not granted a second interview your petition will be returned to USCIS where it will expire and die.

Then marry and file a CR1. Visit more while waiting and continue to gather a variety of quality relationship evidence.

You will then have a good chance to be approved.

CEAC will say AP even if the visa gets refused and returned.

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Cant be just about the age, worldwide older men marry younger women

& its not an issue...even older women by more than 20 yrs have been approved

by DOS...Seem the petition was rushed & the interview was not well prepared for,

one cannot waltz into a 3rd country to live & work without poper docs for that

country, have him spend some time with you in your country & overcome

the red-flag, get marry, then he return & petition you his spouse

Well she couldn't say further other than the age different even if am not educated in USA I have doctrate degree of vet in my country she didn't ask further other than those question but guess we will see what we can do about it

Oh I can imagine you must feel terrible. Me and my now husband ( got married last week ?) have a age gap of exactly 20 years and 20days! We went through this process and it seriously took so much. And I'm not talking about money! Hold on! There must be a way!

I'm just starting my "visa journey" and encountered problem with my medical (posted in another blog) but as I browse ur case got my attention because of the nature of ur relationship with ur petitioner. I have 22 years age difference from my fiancé and our relationship is as real as every normal couple has. I'd like to know what documents did u provide cause from the people I talked to who went on the same process age is not a major issue specially if u provide evidence.

Hope someone from this forum can help you. Pray it's one of the best.
