Ok thank you but wouldn't it be problem if we apply for spousal visa b.c there is still age difference ?

Oh, that issue will still exist and potentially be a problem. We are saying that you will have more evidence to try to overcome this red flag.

It will still be something to overcome, but nothing that hasn't been done before. What I'm saying is that you need more evidence to overcome any personal biases the CO may have given the age difference.

You can not be denied on age difference. Many times CO's will say that to see how you will respond. So what did you say in response to her saying you were the sons age?

Looks on the surface like with him being older and and divorcing and you are not married may look to the CO like you are not serious. He came 3 times so they might be thinking why not marry.

Get married and refile. No you can;t change the age difference but you can sure change the commitment.

A spousal visa might be your best bet to enter the US. If you decide to go that route you need to prepare with tons of evidence your relationship is true. Skype calls, phone calls, pictures (of you and him, of you, him and your family) money transfers, plane tickets, receipts of places you have visited together, etc. remember the CO's job is to establish whether or not the relationship is staged, so every little thing you have to prove there is a commitment from both parts will be needed. As some stated before the age gap is a red flag, so your relationship will get more scrutinized than others might be solely based on this and you have to be prepared. You can also talk to an immigration attorney Good luck and relax. You still have good chances to be with your loved one!

What kind of evidence did you submit when you filed your I 129?

And how long did he stay when he visited you three times?

Did you ever visit him in the US? Did you ever meet his son or other family members?

I agree that the age difference might be a red flag but there was probably just not enough evidence, I read about a lot of couples who also had big age differences but didn't have that problem.

Could they file for K1 again or can they only do that once? Might be faster than spousal?!

I had all the evidences but she didn't bother to see it she only asked me for pictures and I gave her plenty and just looked the first two I had all the other evidence Viber txt, emails from him and his mum and I met his family on skype too his kids and his mum and his brother I told her that but she didn't care
