You can have the USC contact his/her Congressional representative or Senator. Have them also contact the embassy and ask for a second interview. With the K-1, the embassy can send it back to USCIS and the petition will expire.

If the embassy won't reconsider or if the representative can't help you persuade the embassy to grant a second interview, you can marry, then file a I-130. You may also want to think of living in another country as a back up plan too.

If you do get a second interview, try to make sure both parties are at the interview. They can still deny you, but having both there may help. If the USC can come to the interview, have him/her mention this in their email to the USEM.

USC is United States citizen.

Yeah, it's a sad time. But at least you have a chance to try again. See if there were other red flags in your case too.

You have a very large age difference. You two will need to overcome this. It may not be impossible, but it will be hard.

What sort of evidence did you present during the interview to compensate for this age gap?

Moving together to another country for a while would certainly help any future petition; the best way to overcome the big age gap red flag is time spent together.

The co asked for pictures and asking question regarding his first marriage which took him to. Dissvolve 2 years and we met 1 year and the court gave him the paper work on the weeks before we were submitting the case to uscis then she kept telling me that am same age as his son bt am 3 years older she only asked for pictures then she said unfortunately I can't issue you visa

He have known each other for almost 2 years visited me 3 times I told her that too but I guess they go on with their mood to deny or issue visa that's what I felt

I think it is excellent to have a back up plan, marrying an filing a spousal visa will obviously take time.

Which country are you looking to move to?

Your case is a hard one. You two have almost a lifetime age difference. So now the next step is to try to ask them to reconsider and start making marriage plans for a different manner and applying again. I don't know what other evidence you had, but you may need to make it stronger. By then, however, you will probably have more evidence of your relationship too.

You mean applying for spousal visa??

You can only apply for spousal visa when you are married. I don't know how you answered some of the questions in the interview, but age difference shouldn't be much of a problem.

With all due respect, it sounds like you need to be better prepared next time around. Age difference is that big of a deal if you can prove a relationship with hard evidence - that means more than just photos and 3 visits in 2 years. It would have also helped if the USC was present at your interview.

I agree that marrying and applying for an i130 is likely your best option. TSC is currently processing those faster than the i129F, so you could theoretically have your interview within 6 months (assuming you marry ASAP and file immediately). Sounds like a long time, but moving to a neutral country could take time as well, and you might as well try!

Good luck!
