We married on the K1 Visa, and the next step is the Adjustment of Status. However, I need to visit my home country, hopefully for several months and would have to apply for Advance Parole.

However, I read on the internet that getting the date of the AOS interview changed (if you need to visit abroad at the time) is not recommended!

So I was wondering if it would be a better option to leave for the visit to my home country, and then my husband apply for the Spousal Visa?

My husband can't get time off work for an InfoPass appointment. I tried calling the USCIS several times, but they only give standard replies and suggest an InfoPass appointment. :rofl:

We'd appreciate it if anyone could help with information. Thanks!

You should apply for AOS right away and hubby should make time for the infopass appt. There is no telling how long you will have to stay out of the USA waiting on the I130.

06/10/2015-Went to info pass appt. Hubby got a 1yr. Extension stamp in his passport and biometrics done

08/12/2015-ROC Approved. Got letter in the mail.

08/29/2015-received new card in the mail.

Thanks for your reply. I was really worried about us having to wait a long time for the AOS interview letter. By the look of your timeline, it seems like it takes about a month. I hope that length of time is the same for us because we have to send it to Chicago. Thanks.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You file for AOS, EAD and AP at the same time. You will get a biometrics appointment in about a month. That is not the interview. It is for fingerprinting and a photo. The EAD/AP will take about 60-90 days to receive. If you should get an interview, you would need to return for it ,or try to reschedule.

If you leave before having the AP or green card, then you will abandon your AOS and you will not be able to re-enter the US. You would then need to start the spousal visa process to be able to return. It takes a year or more to complete.

If you have a valid reason for needing to leave before receiving your AP, you can request an expedite or emergency AP > http://www.uscis.gov/green-card/green-card-processes-and-procedures/travel-documents/emergency-travel

Thanks for your reply. Regarding needing to reschedule the interview (if I should get one), do you know if I could select a date to reschedule or do I not get a choice of date?

You do not choose. If you ask to reschedule, they can take a while to make you a new interview date. They also may want a reason why you cannot make your already scheduled appointment.

I would suggest that, if at all possible, you should strive to attend the USCIS-scheduled interview appointment. Once you get your conditional GC, you are done dealing with USCIS for ~ 21 months.

I would suggest that, if at all possible, you should strive to attend the USCIS-scheduled interview appointment. Once you get your conditional GC, you are done dealing with USCIS for ~ 21 months.
