Is it true that the process/forms for AOS is a bit easier than those for the K1 visa?

My fiance's interview is coming up and he'll be here shortly (yes he will I tell myself!!) and I started looking at the requirements for AOS.

It seems the forms are much easier to complete.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

The process is a little different in that you will first need to get married. Then after that, you apply for Adjustment of Status. The process can go much quicker, but what is very different is that the two of you are together. A lot of the aspects are the same and they ask you to bring everything that you ever filed and received from the USCIS. So, start gathering everything together and keep it safe and in order.

You might check to see how quickly the local office is processing I-485's in your area. That will help to decide if you need to file for travel documents (called Advanced Parole) and work permit (Employment Authorization Document or EAD). If you expect the AOS to go smoothly then don't waste money paying for the other applications.

As an example, we applied for AOS, AP and EAD all at the same time and paid fees. She got her EAD and AP three weeks before the AOS interview. They confiscated the EAD and the AP was no longer needed with the issuance of a green card.

Doesn't happen with everybody though.

If you think you want to work soon or travel soon, file for interims.

We'll apply for the EAD but I don't think that the AP is necessary at this time.
