Hello Everyone,

I just became a U.S Citizen and i want to request my parents and brother, i know i need I-130 , I-485, and I-864 forms.

They're currently living in the U.S and they enter with Tourist Visa. I want to know what evidence or paper work do i need to send. Thank you!

The adjustment for your parents should be relatively easy.

Unfortunately, you can not file to adjust your brother's status. He must return home. It would take about 12 years for you to petition him. Once your parents become LPRs, they can petition for him. It will be either 2 years or 7 years depending on whether he turns 21 during the wait.

UNDER NO CIRCUMSTANCES can he overstay his tourist visa and later adjust without a problem. Overstays are not forgiven for a sibling of a USC. Overstays are not forgiven for the child of an LPR.

Your parents are immediate relatives and can adjust, but not your brother.

For the parents, you need to follow the instructions for the I-485. They will also need supporting documents and forms, including medicals(I-693). You should also file the I-785 and I-131 for them as well. You can check the guide here on VJ for filing for a spouse. They won't need all the same evidence, but it can give you a general idea. Read the I-130 form instructions for exactly what is required for an immediate relative mother and father.

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
