My wife and I just got married and have began working on her AOS, and we are wondering if we need to file for form i-131 (advanced parole). She will have to go back to Russia next summer for her sisters wedding. Will she be able to freely travel after the greencard is issued to her or will it be 2 years or so until she can freely travel back and forth from her family in russia. We would rather save the money needed from filing the i-131 form if it's only nessesary for traveling while the greencard is processing. Any information would be greatly appreciated.

hi

in the first place, there is no cost filing the i131 with the i485

secondly, once she has her GC, it doesn't matter if it is 2 years or 10 years, she can travel abroad for short periods of time, meaning trying not to be out of the US over 6 months

So yes, you should file advance parole since she is planning to go back home, even if it's next summer. Sometimes it takes time for AOS to be approved.

Yes, your wife will be free to fly to Russia and to return to America if it will have a green card.

I think everyone should file for the Advance Parole because you never know if an emergency comes up and she will need it. Sure you can get Emergency AP directly from USCIS but then you have to pay $360. It's better to apply for it when it's free and then you have it and you can do what you want, if you want to use it or not.

If your wife wants to use your last name, then file with her married last name, and there's a line called "other names" which she needs to put her maiden name. Tell her to use and sign with her married name on all legal forms from now on. That's what I have been doing.

A follow up questionow if anyone can help as I don't want to make another post. When filing for adjustment of status, should I use my wife's old last name or can I prepare it with my last name now. I don't want to send the wrong thing.

She uses whatever is her current legal name. You guys already married. Did she officially change her name as part of her marriage? If so, then her new name is her current legal name. If not, then her current legal name is still what it was before.

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

If she is changing her name through marriage, then she will use the married name on all AOS paperwork. The EAD/AP and green card will come in the name you use on the forms. Enter maiden name where it asks for other names used/maiden name.
