Hello,

I know that this is early to be thinking about these things, but I know that there are some times when it is necessary to begin planing ahead.

I am optimistically expecting that my fiancee will be receiving an interview in about 4 months. I know that they will send her some information that she needs to fill out to bring to the interview, including payment for the visa appointment, the online form, etc. I'm wondering about what she needs from me to send to her. I think I am supposed to send her a complete copy of the application I filed for the petition. She needs to know this cover to cover for the interview because their questions will be based off of it. I believe I also must send her an affidavit of support. I am not qualified to support her myself, so my parents will be joint filing with us. I know that their income is adequate to fulfill the minimum financial requirements for the adjustment of status phase. Do I also need tax returns and bank letters? Does my list look like this?

-Copy of complete application

- Affidavit of Support from Sponsor (Me)

- Letter from bank stating bank balance, deposits over the last 3 years, and date account was opened for all bank accounts listed on the form.

- 3 years of tax returns

- Affidavit of Support from cosponsors (My parents)

-Letter from bank stating bank balance, deposits over the last 3 years, and date account was opened for all bank accounts listed on the form.

- 3 years of tax returns.

I am aware that the requirement is only 1 year, but I have read providing additional years makes it easier for them to make a decision, especially if the 3 years shows solid stability in income.

What else will I need to send to her and how soon should I have these materials together and on their way to her? I don't want to wait until they contact her and she is expected to set up an interview. It takes time to get them together and to get them mailed halfway around the world too her and forever for her local post office to process and deliver them to her back alley address >:(

- Affidavit of Support from Sponsor (Me) No AOS from you. The AOS is done after you arrive in the US and you are married. You need to prepare the I-134 and chances are they are not going to ask for any of this from you but they recommend having it in case the Consul ask for it.

- Letter from bank stating bank balance, deposits over the last 3 years, and date account was opened for all bank accounts listed on the form. Don't need this either as the Embassy doesn't care how much is in your account.

- 3 years of tax returns Only need IRS 1040 for 2014 from your petitioner.

- Affidavit of Support from cosponsors (My parents) I-864.

I-864 is the required form. US embassy Manila prefers that the joint sponsor for K1 is an immediate relative of the petitioner (ex: parent or sibling). They do not have to except the co-sponsor for a K1, but each case is different. We have seen approvals and we have seen rejected applications.

If the K1 visa application fails, you can take the spousal route. You would marry in the Philippines and then file for a visa In the IR1/CR1 category, the joint sponsor can be anybody (relative or friend) as long as they meet the requirements. This process the CO must take the sponsor.

Use the K-1 Embassy Letter as it is different requirements then the IR/CR-1 visa. The documents that in this letter are the only documents you will need for the interview. Follow the EL closely and you will do fine at the interview.

Do not need to send a copy of the petition (I-129F) a copy of YOUR G-325A may be helpful.

Copy of the most recent tax return and W-2 are required of you and the co-sponsor. (one year)

You say that I do not need an affidavit of support until the adjustment of status, but the I-134 is an Affidavit of Support. Not the same as the one submitted later, but when I am speaking of an Affidavit of Support, I'm talking about the I-134 document. My parents would then fill out an Affidavit of Support I-864, both of which should be signed and mailed to my fiance.

Honestly, if I'm mailing anything to her, it makes little sense to not just include a copy of the petition application. At the very least, she has it for her own personal use to review what was submitted and be well prepared for the interview.

In regards to not sending the extra information. I'm only sending it to her so she has it available if it is requested from her. I would hate for her to go to the interview and have them ask for something and she not have it with her. It isn't for the purposes of giving them more to look at it, just want her to have it on hand just in case she is asked for it, she can be able to provided it instantly and not cause delays while they wait for us to get it to them.

That asside, Nolo says this in their Guide to Fiance Visa's manual:

"As a part of proving that your fiance can support you financially, he or she will probably be asked to provide federal tax-filing information - at least one year's worth, and maybe three. There is no need to include state tax information.

The consulate prefers to see the tax return in the form of IRS transcripts (an IRS-generated summary of the return that your U.S. citizen fiance filed), which your U.S. fiance can request either on line or by mail. If for some reason that doesn't work, you can submit photocopies of tax returns - just don't forget to include the W-2 forms."

© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern
(D) List containing serial numbers and denominations of bonds and name of record owner(s).

Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form. 6. A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well) 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, online chat logs (pick several over the prior few months), etc.. from between the time you filed and present (NOA1 until date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)"

I realize that I have all these resources, so why am I asking? Well, simply because there are differences in the required documents listed from each location, and unfortunately your response doesn't make me feel more comfortable because you are telling me to send even less than they are.

I just want to be sure that my fiance has everything she needs or may need when she goes to the interview. Better to show up with a briefcase full of information and not need any of it than to show up with almost nothing and have them ask for things she doesn't have. I want to b sure that I send all the things she needs to her in enough time so that she gets it for the interview and I'm just wondering if there is anything I'm missing and when is the earliest that I should consider getting these things together and sending them to her.

I apologize if my words sound harsh or condescending. They aren't intended that way. Just offering my own information and where I'm getting it so that I can corroborate different sources together and get an affirmative answer to when and what?

Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 5. You will need several items (for the above form). (A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance

(B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available)

© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern

(D) List containing serial numbers and denominations of bonds and name of record owner(s).

Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form. 6. A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well) 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, online chat logs (pick several over the prior few months), etc.. from between the time you filed and present (NOA1 until date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)"

I realize that I have all these resources, so why am I asking? Well, simply because there are differences in the required documents listed from each location, and unfortunately your response doesn't make me feel more comfortable because you are telling me to send even less than they are.

I just want to be sure that my fiance has everything she needs or may need when she goes to the interview. Better to show up with a briefcase full of information and not need any of it than to show up with almost nothing and have them ask for things she doesn't have. I want to b sure that I send all the things she needs to her in enough time so that she gets it for the interview and I'm just wondering if there is anything I'm missing and when is the earliest that I should consider getting these things together and sending them to her.

I apologize if my words sound harsh or condescending. They aren't intended that way. Just offering my own information and where I'm getting it so that I can corroborate different sources together and get an affirmative answer to when and what?

Sorry, I'm still confused about the forms I'm submitting. I as the sponsor, must submit the I-134 form. My income is not close to enough to show ability to support her so my mother will be filing as a co-sponsor. I need to include her paperwork as well so that the officer doesn't deny the visa on the grounds that I definitely would end up making my fiancee a public charge. Tell me if I am incorrect. I think that along with my I-134 my mother must also submit an I-864 form. There is also an I-864a form that says it must be filed with the I-864 as the contract between sponsor and co-sponsor. Do I have these forms straight?
