Today I sent this email to our adjudicating officer for my husband's AOS -

.....On March 9, 2007 (about 10 days from now) it will have been ONE YEAR since we had our interview for my husband's Adjustment of Status, and FIFTEEN MONTHS since his namecheck inquiry was begun.

I assume there is still no news on his namecheck. Where is his physical file? Is it still in your office in Pittsburgh or has it been sent back to Missouri? Is the check still with the FBI or the National Security Unit?

You asked us to be patient and I think we have been. A year is a very long time to wait but unfortunately all evidence indicates it is going to be a lot longer. We have no reason to hope that my husband will have his greencard any time soon.

We are aware that 'national security' issues are involved. We are aware these things take time. However, after a reasonable period of time passes, one can only assume that laziness is involved. My husband's file must have so many namehits that nobody wants to be bothered getting to the bottom of the issue. It's easier to shuffle it to the bottom of the stack.

In the meanwhile we are trying to find a lender who will make a mortgage loan to an immigrant with no recognizable legal status. My husband has to explain to potential employers that he is 'work authorized' but not a 'permanent resident'. We have been advised that it is also best if he not travel outside the country, because Advance Parole will change his entry status.

How much longer is the United States of America going to make my husband feel as if he is unwelcome? He has done nothing wrong.

The security check remains pending. Until a response is received we are unable to proceed with processing.

We understand that you are anxious and frustrated, however, the law requires all applicants complete a background check to ensure the safety and security of all Americans. As per the information you were previously provided, we are not able to provide a timeframe regarding the processing of security checks.

goddamit! :( What the hell can be done? There's got be some kind of legal recourse in such a case - perhaps legislation passed that would put reasonable time limits on how long someone is being checked. Include in that legislation that the case is assigned a specific officer who you are notified about as to their name and telephone number so that you can contact them directly. What a travesty.

Don't you just hate it when you get canned responses? You spent hours drafting a nice, politically correct, calm email and here you get a nonchalant response. Geesh. Would it hurt them to research your case a little bit before responding.

The irony being if Wes was a bad egg (and we know he isn't), 15 months is a long time to learn how to build a dirty bomb, learn how to fly (and not land) an airplane, start funding al quaeda, etc. All whilst in the US of A.

Seriously, not even Franz Kafka could have come up with this sh*t.
