First, let me say that I'm sorry you had to go through all of this. It must be emotionally confusing as well as logistically confusing. It seems you would not be responsible for her in any way since she has petitioned for you.

You said your return flight was in a few months. Sometimes it's possible to change the date on your flight without much of a fee. You could call the airlines and ask a few questions. I'm thinking that you have to find a place to stay and food, etc for the time you are here-and all of that will cost you money so perhaps an earlier flight would be helpful to you, even if there is a fee.

I wish you the best in what has to seem like a nightmare.

Oh yeah, maybe that's the case......looking to see if the petitioner is supposed legally to support op until they leave.

I would have "one" sit down face to face conversation, and tell the petitioner, that if things do not change, you will go back to your country. Just change th date on the airline ticket.

Go when they have an open seat and probably no charge to you.

After the "face to face".,.,.,you will know if it is time to pact your things.

Good luck. A terrible situation. I feel for you.

No, you don't have a face to face with someone who is abusive. You do not walk away, you run.

To the OP: why leave in two months? Why not leave now?

Hi all, the situation is serious so I would appreciate any help.

I'm from a country in Europe and, after having my K-1 petition approved, I came to the U.S.. to my fiancee (who is the petitioner) one week ago. Unfortunately, she started emotionally abusing me, making threats and blackmailing me and many many bad things went down. I don't want to go into the details but needless to say I don't feel safe anymore and do not want to stay in this relationship after going through all that only the FIRST WEEK of me being here.

I have the following questions:

1) how can we cancel the visa and how long does it take?

2) when it gets cancelled, do I have to immediately get out of the country? I have a return flight but it isn't for another two months.

3) once the visa is cancelled, am I no longer any sort of financial responsibility (or any other type of responsibility) for the petitioner?

Help is much appreciated, I am looking forward to your replies as soon as possible

She is not legally responsible. Before leaving make sure you report this matter to the USICS in writing so they know what actually happened in case you plan to travel to the USA,in future. This will prevent you fiancee to further abuse someone else because the immigration may not allow her to petition for someone else in future. Moreover you will have a documentary proof that you made them aware about the circumstances.Who knows what story your fiancee tells them in case they ask for it.It is my personal opinion.

I know I'm going against what seems to be the trend in the responses, however, u, the beneficiary seem to be asking if u can remain in the US and require the OP to take care of u whilst here. I swear, I'm not jaded, but if I were being abused as u claim I would seek to exchange my ticket for the soonest return date possible. The very fact that u are researching her financial obligations to u makes me wonder about ur version of events. Why would u want to stay in a foreign land when u are ready to walk away from the relationship that brought u here? The fact that you should return to your country seems obvious unless ur objective has always been to immigrate to the US. If I have misunderstood and u r being abused then that won't change and I'm sorry for your troubles. Revise your return date and leave. If your ulterior motive is to immigrate to the US then your OP is not on the hook for you and I as a tax payer don't want to support fraudulent behavior either. Revise your return date and leave. Good luck to you and yours.

Jesus people, I asked so I know if I can stay over some friends I have in the U.S. until my flight leaves cause I don't want to stay at her place a minute longer! My ex fiancee is telling me that I can't leave to any other state or anywhere else because if anything happens to me she is financially and legaly responsible. Her dad is also saying he called a lawyer that said, while the I-134 is not legaly binding, it could still be used to make them responsible in case I had to pay huge medical bills or if I don't know what.

I have NO intention of immigrating, I asked this so I know if I can just leave her place ASAP and stay over with friends until my flight leaves in a couple of days, she's saying she can't let me leave the house cause if anything happens to me I'm her responsibility, and that she'll call the police if I do.

Sorry for misunderstanding. She cannot keep you there nor is responsible for you in any way.

No one understands what the issue is? HE IS NOT FROM THIS COUNTRY AND PERHAPS HE DOESN'T KNOW IMMIGRATION LAW-and doesn't know what to do!

I'm from this country-have been thru 3 lawyers and 2 online forums and I'm still confused. Do you think someone who arrived here a week ago understands what Congress has ruled on for specific immigration forms? And what has been proven to be unenforceable? I sure don't know these things. Did you know these things in your first week?

You all are being really hard on him. He is asking for help. He is trying to find out what he can and cannot do. Answers like, "what's the problem" aren't really helpful. Accusing him of trying to stay in the US when that's not what he said isn't helpful either.

If you went to another country would you know all the laws of that country the first week you arrived?

Dear God people, he is in a horrible position (no money, no place to stay, no food) and is asking for our help-not our ridicule or our accusations. Really I'm shocked at some of these answers.

Well, this makes things more clear.

Leave, she cannot keep you if you don't want to stay. Leave ASAP.
