Hi all, the situation is serious so I would appreciate any help.

I'm from a country in Europe and, after having my K-1 petition approved, I came to the U.S.. to my fiancee (who is the petitioner) one week ago. Unfortunately, she started emotionally abusing me, making threats and blackmailing me and many many bad things went down. I don't want to go into the details but needless to say I don't feel safe anymore and do not want to stay in this relationship after going through all that only the FIRST WEEK of me being here.

I have the following questions:

1) how can we cancel the visa and how long does it take?

2) when it gets cancelled, do I have to immediately get out of the country? I have a return flight but it isn't for another two months.

3) once the visa is cancelled, am I no longer any sort of financial responsibility (or any other type of responsibility) for the petitioner?

Help is much appreciated, I am looking forward to your replies as soon as possible

You do not need to cancel the visa, you can leave the country any time without getting married. You are allowed to stay in the U.S. for 90 days, in the normal case you would have to get married in that time, but if you don't get married and leave the U.S, nobody will care.

I don't think that you have any financial responsibility for the petitioner, it is the other way around, she needs to sponsor you.

Nothing to cancel, the visa was made void on entry, you have until the date expires on your i94 to leave the US. You have no responsibility to anyone here once you leave.

Visa is already canceled.

You have 90 days.

No financial responsibility unless you marry and adjust.

Thank you for the replies, it really means a lot.

My (ex) fiancee keeps telling me that while I'm here, if anything happens to me she has to pay the medical bills (that's why I asked about financial responsibility). But now you're telling me it isn't true?

I know that once I leave the country I am no one's responsibility but I'm asking about while still being in the U.S.

Only you (OP) knows if this was submitted.

Read page1: item 4, 5, and 6.

It states that the petitioner (US Citizen) is responsible for the beneficiary during his or her stay in the US.

Part of the K1 process is that the embassy MAY ask for a i-134.

Only you (OP) knows if this was submitted.

Read page1: item 4, 5, and 6.

It states that the petitioner (US Citizen) is responsible for the beneficiary during his or her stay in the US.

Google "I-134 legally binding." The K-1 petitioner is not financially responsible for the K-1 visa holder.

Your answer agrees with what previous posters said.

I personally would not have signed my I-134 and became a sponsor if I was not prepared to fulfill what I think it says.

A couple of things to think about. Rhetorical questions. No need to answer.

1. Do you trust google for legal advise? How far do you trust it?

2. The difference between what is said and what is legal.

3. The difference between what is currently enforced and what could be enforced.

4. There are a variety of possible plantiff's that could try in court to get something from the beneficiary.

Quoting a post from a simple search on the forums (the blue is from a government document, search for it online if you want).

Because INA 212(a)(4)(C ) and INA 213A require the use of Form I-864, Affidavit of Support Under Section 213A of the Act, for so many classes of immigrants, the use of Form I-134, Affidavit of Support, has been reduced considerably. Nevertheless, there still are circumstances when Form I-134 will be beneficial. This affidavit, submitted by the applicant at your request, is not legally binding on the sponsor and should not be accorded the same weight as Form I-864. Form I-134 should be given consideration as one form of evidence, however, in conjunction with the other forms of evidence mentioned below.

"The US government tried to enforce the I-134 numerous times in court and failed. The contract portion of the form was badly written. Congress passed a law in 1996 that required an enforceable affidavit of support for immigration, and added section 213A to the INA. In response, INS produced the I-864. Consulates still use the I-134 for non-immigrant visas. "

I didn't know congress even ruled in on this issue.

Immigration is such a complex mix of things. Part of it is legal. Part of it is administrative. Some portions are strictly enforced. Some portions are ignored. Some portions are subjective.

That is why a site like this is so important to try and make sense of it all.

What to do about what? No one is financially responsible for you, especially since you aren't even married. The petitioner would only be responsible if she signed I-864 along with a visa application and it was approved, which is not you case at all. I don't understand why you are so concerned.

If she is being abusive leave her and return to your country, after 90 days and no wedding there is nothing you can do.

If she is being abusive leave her and return to your country, after 90 days and no wedding there is nothing you can do.

That's why I'm saying I don't understand what the issue is.
