Hello To everyone!

Thanks everybody Will Answer my Questions ....

I Sent my Adjustement of Status to USCIS and they Send me notification that they receive my Papers but After that they Sent me Other Letter that it Says : Request For initial Evidence (I-485) And they Ask about 2 more papers :

W_2s ( But my Wife Does not work because She Get money From Alimony and Child Support) = Wiches We prouves that With papers To immigration.

Federal Tax Return = We Sent them For USCIS

And We called the USCIS but they Answer that Maybe ( They Was not Sur ) Write a letter Expline Why We dont have Thoose 2 papers !!!!

I Was Juste Wondering If Somebody Was have the same Situation like Us Now and What is the Solution About it ...

Do We have To send the Tax for 2006 ( they are not Due Till April ) and the immigration Says that We need to Submit the papers in 87 Days !

You received what we abbreviate to be an "RFE". The USCIS is asking for more proof about your financial situation. Even if you've sent the documents before, send them again. Read the instructions on the I-864 carefully. You may need a co-sponsor if you do not meet the income requirements.

if you do not het W2s the best solution is to order your tax transcripts from the IRS. the transcripts are accepted as a true indication of your income. you could order the 2005 year. does your wife not get any tax forms for the alimony received? you can order the tax transcripts from the IRS for free but they can take a few weeks to get or you can pay to order them from accuverify.com

the problems with just sending a copy is that is what is submitted to IRS not necessarily the final filed amount. just re-submit everything they are asking for. hope that helps

do you have bank statements showing child support / alimony payments being put into an account? what exactly did USCIS ask for in the request for evidence letter? it sounds like they want W2 and tax return-sounds like you gave them the tax return but no w2s. I understand that your wife does not get W2s, neither does my husband-so because we did not have W2s we sent in a tax transcript which USCIS will accept in place of missing W2s.

Hi! Thank you for writing.

Background notes: my divorce was finalized last year, and all of the taxes are "married filing jointly" with my ex-husband. I've been a stay-at-home mom (I supported my ex while he went to school, and he was supporting me while I took care of the kids) with no income of my own. In the divorce settlement it states that I will continue to receive payments for child support, alimony, and equitable distribution (even though I remarried). The amount I get is enough for the USCIS requirements.

USCIS asked for W-2s, 1099s, and/or all schedules submitted to the IRS; Federal Tax returns for the most recent tax year; and evidence of current employment (to summarize).

When we sent in the AOS and EAD papers, we included return transcripts for 2003 and 2004, and the tax return for 2005. The 2005 return included all schedules, but no W-2s or 1099s. I guess maybe if I order a return transcript for 2005, that will be fine. Good idea - thanks for the advice!

I read somewhere that 2006 tax returns are not required yet, and I hope that is true (this first one on my own will be a bit tricky, and may take a while). If I have to, I will file a return for 2006, and then an amended one later (once I figure out all that needs to be done for it) - or an extension.

As I am not employed, I can't possibly get evidence of employment. With the forms we sent already, we sent copies of everything we had to show my income. We had letters from the immigration lawyer, my divorce settlement, and I noted on the Affidavit of Support that my income was derived from alimony and child support. I will copy everything and send it again, along with bank statements (another good idea - thanks again!) showing all the deposits of the checks from my ex. I'm also writing a very long, detailed letter explaining my situation again.

I would suggest you file your 2006 tax return and send it, along with a cover letter, explaining the REASON for the lack of attachments to ANY tax return.

Send your property agreement from your divorce (again) and highlight the pertinent areas about your support payments. Allude to the agreement in your letter.

Spell it out for them. My I864 was a bit complex but I covered it with a detailed letter and there were never any questions.

I would strongly recommend you file your 2006 taxes and send those along as well. A bunch of people, myself included, who filed around this time last year got RFEs for the I-864 although we had sent it in, and we thought it might be that they wanted 2006 taxes. Plenty of people get RFEs for the I-864 throughout the year, so it's possible it had nothing to do with it, but it happened to so many of us you might want to just get ahead of it.
