please help ...refused visa after interview due domicile of the wife (f2a)

hello guys

one of my friend his visa was refused before few days due domicile reason since his wife was leaving with him for many months because she is pregnant now and before one years she was out side the us because she was completed her stayed on university (she went to US many time but it was for short periord like 2 month for each visit

the officer she asked him to ask his wife to maintain the domiclie and then back to embassy with evidence of that... and as she told him she has to get house on rent and other requiemnts any more advice guys ?!!

what he has to do now and when he can comeback with all evidence ?!!!

What country?

From my country, this is very common. The US citizen must relocate to the US to demonstrate domicile has been reestablished before a visa can be issued.

He should have been told or given a letter saying how he will need to present the evidence; some embassies will want it sent in by mail, others will schedule another interview.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

he got a letter to revisit the embassy with his evidence any date after 2 pm

so I'm asking about the best steps to solve this issue since he wife pregnant she is not able to work so

1- what she can do to reestablish her domicile

2- if he get good evidence when he can back to embassy to show them this evidence ?!

1. How long has she been abroad? What ties does she still have to the USA? For example, she may not have a job, but what about a lease to a home, furniture in storage, cell phone valid voter registration and drivers license etc? How much longer does she plan on staying abroad? It may be easier to ask for a delay, and once the baby is born, have her move back to the USA, find a new home and job and then request a second interview.

BTW, is she a greencard holder or US citizen? If greencard holder, she may have more problems than his visa....

the updated status as below

the wife (the petitioner//LPR) went back to us few days ago she is living in us right now and she will going to do the below

1- rent a house and paying the utilities of the house services (water elec....

2- buy a furniture

3- buy a new cell number

4- get voter ID

5- driving licence (she have already ) 1 - is it enough or any thing extra required ?!!

2- when the husband (the applicant) can back with all this evidence to the embassy ?!! as per the embassy officer during last interview he told to come back after all the evidence to maintain the domicile ready ?!! can he back to embassy after few weeks ..one or two month like this

What do you mean update? When you have all the paperwork proving your wife has moved to the US and is living there (rental agreement, renter's insurance, utilities bills, driver's license, voters card, pay stubs) - then send it to the embassy - unless they allow you to come and drop it off in person.

what about voter card where you can get or apply it ?!

You can go to the USCIS website. http://www.uscis.gov/i-864 Then click the instructions to form I-864. Search for word "domicile". It clearly mentions what you need to establish the Domicile. If get a job in US that would be the highest proof of establishment. Ofcourse you need to lease an apartment etc. But job with a lease of apartment gives the 100% proof. Without job an apartment may also convince the officer at embassy but not 100% sure.

Please go thru the above instructions of the Form I-864. They clearly mentioned what you need to establish the domicile.

the wife can't work since she is pregnant but house they will get on lease since the husband has good job and good saving of money on his country and already they have joint sponsor approved from NVC

is it enough as proof ?!!

They signed a lease for a house? That is a good proof, but more would be better. Having only one bit of proof is weak, though chances of approval also depend on the consulate- some are far picker than others.

Yes She signed a lease for a house and she reactive her cell phone and her bank account

And she will start paying a house utilities and buying furniture for the house and she will apply for healt insurance for hospital check up

Any more advice guys or its ok ?!

hi my interview appointment is october 12 2015. i am the usa citizen but i have been living with my husband here in uae for the past 3 years.

wow i hope i do not have to go through that also. I still have my bank account in usa, and my car is in uae, and i am using my moms address as a place where i get my mail at until we reach usa. all to show proof of me still being connected to usa. i hope that i enough for the embassy

Unfortunately that not enough you have to show them more proof
