AOS+name change+RFE, please help

Hello everyone... This might be a longer post, so I reeeeally hope someone will read it and help me.

So, before I sent my AOS documents a few months ago, I went to the SSA to change my maiden name, but they told me I cannot do that until I get my EAD, so I sent my documents with my maiden name on it.

Just before going to my biometrics appointment, I got an RFE, for 2014 tax returns. Since my husband owns a business, he gets his tax returns in September.

We have collected a few documents showing he earn more than enough to support me, but then I got another RFE, with them insisting on a 2014 tax returns.

Well, I will get them tomorrow, and then send them on Monday. However, in the past few days my friend told me she sent her AOS with her husband's last name, so she got her EAD and her Green Card with her married name on it. Now, I am afraid, if my EAD is on my maiden name, the SSA will not let me change my name, and then, I won't be able to put my married name on a driver's license.

My question is, is that true?

AND also, if I send my second RFE with my married name on Monday (having been sent the previous times with my maiden name), will that "confuse" them enough to REJECT me? And if not, will they "take it", as in, put that last name on my EAD?

You could have submitted all documents with your married name as long as you included a copy of your marriage certificate, which is actual proof of a name change, you don't have to change it at the SSA for it to take effect.

It should not be an issue submitting tax docs in your married name, however, since the forms were submitted in your maiden named the documents will be printed with your maiden name.

We filed all of Danielle's AOS, EAD, AP paperwork last week and were advised to do it ALL in married name, putting herm aiden name in any spot that asked "other names".

But I don't think you are in any type of problematic situation here, just a few more hoops to jump through after it's all said and done. We went to the SSA to get her SSN in her married name (something MANY said is legit, even the call center support for SSA advised us to do so), but the lady wasn't having it, got Danielle's SSN in her maiden name in the mail a week later. When she gets her EAD, we can go change it at the SSA office. Then we'll be able to get her a state ID with her married name, green card will be in married name, etc.

In your case I think you'll get everything in maiden name, and once you get it, you'll have to do a name change on all of those, which will take some time and cost some extra money, but I don't think it's anything backbreaking.

If you changed your name when you got married, why did you file for AOS/EAD on you maiden name?

Of course your EAD and GC will now be in your maiden name.. But I think what you'll have to do is change your name on your EAD/GC once you have it, then you can change it on your SSN card and then your drivers license.

I think on Page 16 it tells you. You pretty much just have to fill out another application and check some different boxes.

I think she was saying she went for her SSN before filing AOS, and the lady at the SSA told her she can't get her SSN in her married name yet, and theat led her to believe she needed to file her future paperwork in her maiden name.

So, is it possible to change my EAD and my GC to my married name, and how?

If the Green Card is issued in your maiden name but you wanted to change it to your married name, you would have two options:

  • File an I-90 to have it reissued, this will have a fee of $450.
  • When the time comes to Remove Conditions, that paperwork can be filled out using your married name. You will need to submit documentation showing a legal name change (e.g. a marriage certificate).

Since I still have my RFE to send, I think I will call them tomorrow and ask if it's too late for me to change it. If not, I will ask for it to be reissued... :(

I don't think it's a big deal. Even if you can't change it right now, it's not gonna stop you from working, traveling, driving or anything. In the end it's just gonna be more paperwork and more costs.

Since your SSC is in your maiden name, wait for the GC to arrive to prove your are a LPR. Since you completed the I-485 with your maiden name it will be issued in your maiden name. SO you will have to use your Marriage Certificate at your local SSA office to get them to change your SSC with your married name. You then should be able to get a DLs in your married name. Your next chance to change your GC name will be at the removal of conditions (ROC) stage. At least you will not have any problems traveling internationally as your GC and passport will both be in your maiden name. Just use the Marriage Certificate to show you are married and insist that people put your husband's surname as your last name.

You cannot use the EAD to change your name. You should have applied for AOS/EAD/AP in your married name. You can either file to have it changed after receiving your green card, which will take months and cost hundreds more, or use the maiden name until it is time for ROC and then change it and file in married name for ROC to get your 10 year green card in married name.

If you have an interview, you can also ask the IO if they can issue the green card in your married name instead. Once other option might be to make an infopass appointment, take your marriage certificate and ask that they change your name in the system so your green card will come with the married name and not maiden. It is worth a shot.
