Question about I-693 when filing I-130/I-485 concurrently

Hello all,

When reviewing the guide to file I-130/I-485 concurrently for AOS from VWP, I see that form I-693 is listed as a document to include in the packet.

• Does this mean we need to schedule an appointment with a "civil surgeon" prior to submitting the packets for I-130/I-485?

• Does the form need to be completed by a surgeron prior to submission?

Any info you can provide is appreciated as always, thanks!

Most people that I have seen file their I-130, I-485, I-765, and I-693 concurrently. I would do so as not to delay the AOS process. Good luck!

Yes, what is a medical exam that can only be done by a civil surgeon, once completed if will be given in a sealed envelope and needs to be included with the application.

This is no longer the case. Given that USCIS limits the validity of I-693s to one year from the date of initial submission to USCIS, it's now a good idea not to submit the I-693 with your I-485. The only time I would continue to do so would be when adjusting status from any visa other than a K, since these adjustments are usually granted well within a year. For adjustment from a K visa, which can routinely around a year for interview-waiver cases, you run the risk of your first medical expiring and needing to have a second one performed (at your cost) if you include one initially.

For this reason, my advice would be not to file an I-693 together with your I-485 when adjusting from a K visa, but to continue to do so when adjusting from any other type of visa (though again, you don't have to and could just wait for the RFE).

My guess is that OP is not adjusting from a K visa since I-130 is being submitted.
