B2 Visa Form Question's Answer for F4 Derivative Beneficiary

There is no category for the OP's sister to petition his wife and children. There is only a category (sibling) for his sister to petition him. So it's pretty obvious he does not literally mean his sister petitioned his wife and children.

I was simply quoting OP's terminology.

Also still the answer to the question in form DS160 should be YES?

I am also interested on the answer to this question. Since derivatives are technically qualified for a Visa thru the direct beneficiary; I am thinking a YES on the question. The derivatives are on the system and if the beneficiary will be approved, they qualify as well for a visa.

But other comments here mentioned they are derivatives so NO.

My kids are also my derivative for my F2B, so if am filing up a DS 160 for them, I will answer yes and will explain on the space provided that they are derivatives of an F2B filed on my name. This is me being safe on the disclosure and rather be wrong on this; than answering NO and by the interview the CO will tell me that I should have answered YES.

Let's see if there are others who can clarify more on this.

The petition if filed for me by my sister. My spouse and kids are derivative beneficiaries.

I believe OP is abbreviation of Original Poster. Since this topic is initiated by you so you are referred as OP here.

I have a similar case but slightly different situation. My sister in law has petitioned (I-130) for my wife which was approved under F4 category. Now I as derivative beneficiary applying for B1/B2. I have already answered "Yes" to this question. Do you guys think I should have said "NO" as derivative beneficiary?

In my opinion YES is the safe answer to this question. You can explain the exact situation in the space provided immediately after this question which say "EXPLAIN".

This way, your intention of not concealing anything would be clear.

Thanks emem. I remember you were in the same situation. Have you applied for your B1/B2 lately? If yes, what was the outcome?

Thanks, it was a detailed interview. Various questions asked about Work, Reason for New visit, Previous Visits, Petition, Ties etc. I guess previous history helps a lot. Simple rule to follow, do not try to conceal anything.

I am not sure about whether Derivatives are beneficiaries or not, just that in my opinion YES is the safe answer to this question, as it shows your intent of not hiding the facts.

There is a follow up question to explain further for ALL applicants who have a pending petition.

What did he tell you? Questions asked?

1. Purpose of visit?

2. Any family member or friend in U.S.?

3. How long?

4. What do you do?

5. What does your company do?

6. What's your job role?

7. Any previous travels outside your country of residence?

In the end, he told me that your visa is approved. Yesterday online status was showing "AP". Today it's showing "Issued". Will update when I get the passport.
