B2 Visa Form Question's Answer for F4 Derivative Beneficiary

Hi All,

My sister has filed a F4 petition for myself and my family with priority date of June 2007.

Now i am applying for B2 Visa for my family and am stuck at a question in the form DS160 which is,

"Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services"

What should be the answer to this question in case of a Derivative Beneficiary?

All of my Family Member's names and Other Required Data was duly provided on the form I130 at the time of filing of the petition.

Your expert opinion will be highly appreciated.

the answer is YES. Then there will be an area under that you can provide the details of your F4 Petition. Disclose it and provide reference number if you have any receipt or case number. Never hide anything, they have your name in the system.

lol Answer was very Simple YES.... and you might have high chances to get REFUSE your visa application.

lol.. not necessarily! I have an F2B on file and I got my B1/B2 visa approved.. it all depends on your proof of ties and how you answer questions. My country is also high rate on visa denial.

I dont intend to hide anything. Just thought that since the petition has been filed on my behalf only i am direct beneficiary and my family being derivative beneficiaries might have to answer differently in their respective forms DS160.

Yes Right, i am petitioned F4 and I am the direct beneficiary.

My wife and Kids are derivative beneficiaries. My question was actually for filling in DS160 form for visit visa form of my wife and my kids.

Yes, as derivatives. Just explain it on the space provided. All records are on the system.

Apparently OP thinks so.

There is no category for the OP's sister to petition his wife and children. There is only a category (sibling) for his sister to petition him. So it's pretty obvious he does not literally mean his sister petitioned his wife and children.
