Called NVC again. Like the first time a week ago, I waited between 20-25 minutes.

Still no tracking number... again reminded of the 42 days estimate since they received my case on November 12th.

I'm hoping for better news next week. I'd love to read you're lucky as well! :)

I was actually planning on calling then today but after your comment i might wait a little longer then. NVC received my packaged Nov 9.

We have the same date.

It takes all my powers not to call then every day. I have said a deadline on Friday where i will call them again.

Then it´s been 22 days and i hope thats all it take.

I just got a email.

My I-129F was approved now, but my I-130 is at NVC for the last 11 days.

NVC will close the I-129F now that they got the other one first right ?

Exactly! If your I-130 is approved, you can't continue processing a K3/K4 visa.

When they say 42 days, is that 42 business days or calendar days?

Think it´s always business days.

Not quite sure, actually. The lady I spoke with today told me mid-December. Since they got my case on Nov 12th, it looks like it's calendar days.

Still, I'm counting on being assigned a tracking number before :rolleyes:

Mine is in Nebraska too but ots in May 25 as showing.

After my NOA2 on November 4th, NVC received my case on Nov 16th.

I wish all Service Centers were moving abreast, I understand how frustrating is for every one not in the California Service center.

We all pay the same fees, there is no be excuse for USCIS providing a regular and timely service across their branches.

We all must unite and write a letter to the head of USCIS and the appropriate committee in Congress demanding an investigation and corrective action. We all need to sign, the lucky ones with super fast cases in a couple of months and the great majority waiting 400 days or more.

I read that you need to have a very strong evidence that you have plans on returning home and not stay in the u.s. A return ticket will not be enough. You need to prove that you have assets, a job or a business from your home country.

The answer to your question is on my timeline, but I will more than glad to answer your question regarding traveling to USA on a B1/B2 visa while a I-130 is in process.

The CBP agents are well trained professionals and I am pretty sure they have psychological profiling skills as part of their training. These skills enables them to weed out with a fair percent of accuracy who is trying to commit immigration fraud.

My wife brought with her project contracts that tie her to Colombia for at least one year, a copy of NOA1 and round trip itinerary. (Personally I believe the NOA1 and the itinerary have no weight).

I believe the main thing she brought with her was being calm, smiley, relax and polite.

The CBP asked her :

1. Who specifically she was visiting; she without hesitation responded "my husband".

2. How long were we married, she said "since last August 5th".

3. How long will the visit last? She said 3 weeks until Nov 8th 2015.

4. When will she move to USA? She said, 2 or 3 months after the CR-1 visa is approved.

The CBP congratulated her for our recent wedding and welcome her to USA.

The CBP never asked for any documents proving her ties to Colombia.

Note: My wife has been holding a B1/B2 visa since the late 90s and has visited me 3 times before we got married.

I am pretty sure the CBP officer has on his screen the record of her previous I-94 or entries and exits.

I believe the admission on a B1/B2 to USA during I-130 processing is a grey area that depends a lot on the record of the traveler and her/his demeanor.

I do not believe a B1/B2 petition will be approved after a I-130 is underway.

Good luck to you and every one who wishes to visit on a B1/B2 while a I-130 is being processed.

No luck for me either. I called yesterday. Im thinking of giving them a couple of weeks before I call back.
