W-8BEN Bank of America Credit Card

Hi All,

I have a Bank of America Rewards Money Market Savings Account set-up in one of their bank locations. I'm sure I can find a better savings account it's just not high on the priority list yet. I have moved here on a K1, got married and recently applied for Adjustment of Status (I have no income as EAD is only just applied for EAD). I have an SSN.

BoA have sent me a W-8BEN Certificate of Foreign Status of Beneficial Owner for US Tax Withholding and Reporting (Individuals). BoA say that they need to certify my foreign status on my account. I'm kinda confused since I'm in this grey area of not being a resident as such so what do I do here? The form asks a permanent non-US address that I don't have. They say "The person named in section A of this form is not a U.S. person", am I a US "person"?! I would thought that now I'm here that I am subject to US tax on savings so is BoA messing up here?

When I last spoke to BoA they still have my UK address on the accounts I have with them and they can't remove this until I have proof of US residency which is the GC.

Let them know you are in the process of adjusting status and send them evidence of that - you're no longer a foreign client of theirs. Give them your US address. That's all they need.

I understand why my wife had to provide the bank W8-BEN because she is still a non-immigrant with an ITIN. But if you are already here and have SSN then wouldn't think it would be a requirement.

I have SSN and applied a bank account with Chase with my SSN. They still require me to fill up W8BEN and also gave me a W9 too. Im so confused with these right now as they said if I do not provide residency proof of ID (TWO) my account will be ceased or freeze! Currently only my SSN proves it! I can't get driver's license in Georgia as I need EAD, not sure about State ID, intend to go today to ask.
