My husband and I have been married 9 months so far and just began the process. We expect it wil take like 8 months to interview and maybe another 5 for AProcessing. That would be aroudn 20 months (give or take) of marriage. The reason I ask is that we are doing K3 and CR1/IR1 . I am not familiar with the in's and out's of adjusting status or even what it is. Since I hear from others that it is an annoying process, I was wondering what we could do as far as options for him to get his 2 year green card if we were to come after our two year anniversary. Like, could I go live with him for the remaining couple of months and then we return together being married for 2 years, and then avoid the whole AOS mess? Anyone know...I know we are thinking ahead, but at the same time, we are trying to plan our lives as best we can. Thanks

If you are married for two years or more at the time of the CR-1 interview, then your husband will get the 10-year green card when he arrives in the states.

If you are married for less than two years at the time of the CR-1 interview, then he will only receive the 2-year card.

On the other hand, if you do the K3, since you've already been married for 8 months, chances are that his AOS interview here in the U.S. would be past your two-year anniversary. So, he would get the 10-year green card.

You've just got to decide what the biggest priorities are. Would you rather be together ASAP, or eliminate the paperwork involved with AOS and/or removing conditions?

When Moh gets here we plan on filing for the EAD immediately but holding off on the AOS for a few months. For one, he'll be able to pay for his AOS once he gets a job, another reason being that by the time we'd have the AOS interview we would be married over two years.
