About to Start the K-1 Visa Process, but have some questions, someone help please :)

Hey Guys!

I was hoping someone could help me out here.

I am going to start applying for the K-1 Visa Process soon, but had some questions first.

My fiance is finishing up college in about a year or so, and will have to possibly go into the mandatory military service program.

Is it possible to apply for a K-1 Visa during this time? Any recommendations?

I would love all the help I could get.

First Trip - October 2015

Second Trip (w/ Family too) - March 2016

Third Trip - July 2016 - He proposed, I said YES!

Fourth Trip (w/ Family too) - October 2016 (Engagement Party)

Fifth Trip and 6 month move to Egypt - January 2017-end of July 2017

March 2017-Family and Friends come for Wedding (March 20th, 2017)

Sixth Trip - October 2017

Seventh Trip (w/ Family) - February 2018

Eighth Trip - May 25th, 2018 - June 3rd, 2018

Ninth Trip - October 26th, 2018 - November 4th, 2018 (w/Family)

Tenth Trip -upcoming March 1st, 2019

I - 130 Stage (USCIS):

November 13th, 2017 - I-130 sent

November 24th, 2017 - NOA1 (Received Hard Copy by Mail)

June 7th, 2018 - Online Case Update - Case Transferred and /New Office Has Jurisdiction

June 8th, 2018 - was told my petition is being sent to The National Benefits Center (NBC)

June 8th, 2018 - Online Case Update - we received your case

June 8th, 2018 - Online Case Update - Case Transferred and New Office Has Jurisdiction

June 14th, 2018- Hard Copy of Transfer Notice (sent 6/6/18)

July 9th, 2018- worked with caseworker at congressional office, made a inquiry

August 3rd, 2018 - caseworker was told by liaison that my case had been transferred to another department for review

August 17th, 2018 - expedite request sent per caseworker, due to USCIS error.

August 27th, 2018 - our petition was yet again sent to the wrong office (Adoption Unit...) another request for expedite was placed by caseworker.

August 30th, 2018 - petition was sent BACK to Nebraska Service Center.  Caseworker spoke with NSC liaison detailing the erroneous transfer that has put your case behind normal processing times, as well as the delays/lack of communication/action at NBC"

September 13th, 2018 - Case was transferred to a new office

September 14th, 2018 - Case transferred and new office has jurisdiction - called and they said it was at Nebraska still...

September 14th, 2018 - Case is APPROVED

September 17th, 2018 - Hard Copy NOA2 Received (PD SAYS 9/13/18)

September 26th, 2018 - Sent to the Department of State (online notification)

October 2nd, 2018 - NVC Received

October 26th, 2018 - Case # Received via email

November 7-9th, 2018 - Submitted DS260 and AOS, Civil Documents, etc. via CEAC

November 14th, 2018 - new police certificate was uploaded

November 27th, 2018 - Case Complete at NVC!

Feb 14, 2019 - Received interview date via email

March 5th, 2019 - scheduled interview date - APPROVED
March 9th, 2019 - Visa in Hand

because if you apply now the visa will be ready in 6 or 8 months and then he need to leave Egypt 6 months after the day in wich the visa was delivered and if he doesnt the visa will not be valid anymore...you said that he is studying so maybe he will need more than one year to finish

That completely makes sense.

But, I am more concerned with the Military aspect.

Has anyone else had to deal with this, or have any suggestions?

i dont know how it works there in egypt in this bad situation but from what i know in Tunisia he can show them that he is student and then he will not be concerned by the military service

to help you better , I need to know when exactly he will finish his college , and what field he is enrolled in and when he is due to apply for the army ,this will give better idea for decision . Egypt strictly do NOT allow students to travel once they are in the final year in college. you have two options here :

option one ( spousal visa CR1 ) : this is a trail that might or might not work , but if it worked,you both will save the period he will spend in the army which may take up to 3 years. get married in Egypt as soon as you can ,certify the contract in Egypt ,this will give him a very big chance to be exempted from the army ( as being married to foreign wife ) if you want to do him this BIG favor, and he should owe you this all his life :) ,but still not 100% guaranteed. so then whether he got exempted or not ,go ahead with spousal visa (CR1) which takes a bout a year( if his service will be one year ,not 3) . thats my personal opinion.

the other option ( k1 fiance visa ) : you both need to wait till you know how long he will serve in the army (1 or 3 years) because if the visa issued,it's only valid for 6 months,then you should start the process a while before the end of his service and also because he will need to send his end of service certificate along with the papers in packet 3 to the embassy .

let him just apply for student summer visa its usually for 2 months .............. or mid term visa ............if he got it which is based on mere luck ............. he can stay there join some community college and u start ur life without postponing ..... and get going with ur life dont make the fault i did waiting waiting postponing postponing u ll ruin & waist ur life in such worthless game
