Hi all!

My fiance and I had our I129F petition approved on Setpember 3, so now we are thinking of the next steps. My fiance (the petitioner) is American and I (the beneficiary) am Canadian. Currently we are trying to sort out what to do about the affidavit of support. I am getting conflicting answers online, some sites are saying I will need it for the interview, some say I only need it for the adjustment of status.

So this is our situation- my fiance is currently unemployed and looking for work which is adding to our stress over the affidavit. As well, we are unsure if the income requirement is for household and what to do if there are other earners in the household? He lives in his mother's condo with his brother, she lives with her boyfriend but the condo is owned by her. So would they count under the household? Does anyone else need to include their income? The form only asks for my fiance's information but do his brother, and/or his mother count toward the household or would it be just the two of us as it would just be us he would need to support during that time period?

Thank you, and I appreciate any information anyone can give me, or even a lead on who I could call and ask these questions!

He will need to show ability to support in some fashion, as you can't support yourself currently (if you move from Canada to the US, you won't have a job and can't go on government assistance). Granted, there are other ways you can support yourself, but the K-1 assumes you don't support yourself and your petitioner does.

As far as household goes, it's whoever he has to support, which it sounds like just you and him.

I believe I've read on this site where a family member of someone who doesn't have the means to support the fiance(e) can co-sponsor and provide an affidavit, but I don't know the mechanics of that.

Everyone you live with is not necessarily in your household count.

How to count household size >

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ.

For the K-1 visa interview, you will need the I-134 and supporting documents. See the instructions from your consulate. You will need the I-864 later for AOS after you are married.

If the USC petitioner cannot meet the income requirement, then they can use a co-sponsor.
