Here is a little background i m indiand and my wife is brazilian we got married when i was 20 and she was 22 when we first applied we dudnt live together and i didnt tell my parents and we went to the fraud interview and we lied saying we lived together ( i know it was dumb) and since we didnt have a lawyer i signed the paper to pull back the petetion ( she threatened to put as in jail if i didnt) i shouldnt have dine it but i did . then we get a etter saying we are denied and my wife is going to be deported . So i finally realized we were just dumb that just being married aline is enough evidence. We finally got a lawyer the lawyer reapplied while her depotation was still in process . we moved out and git a place on our own and we had another stokes interview and we explained to the officer why we lied first about living together and our plan was to move out after she get her documents ( that was our honest plan ). Oyr interview took about couple hours and the officer said he will send a letter with his decision. During this time we had our master hearing at the immigration court and during the hearing the judge said t

That the uscis made the decision the sanme day and that we passed the interview. So an individual hearibg was set on april 14th our lawyer said we had a great chace of winning this case and the judge was a nice person. But in november 2013 we got a letter sating our hearind date has been postponed to jan 2016. During this time we had a daughter with the court date coming up im afraid if something bad happens and my wife have to leave me. If tgat happends iwill be tottaly devasted she and my daughter is the only thing i have since my family dont want anything to do with me because i married. What o you guys think of the chances we have winning this case. Please reply thanks a lot.

Ps she overstayed her visa her mom told her to come here when she was 16 .

Stay strong remain as a family, have lots of pictures and evidences the marriage is real

talk to your congress-person, get an atty or talk to catholic charaties if finances are low.

note all your hardships without her, so your atty can use as an argument, tell her stay

out of trouble, don't drive without a license and pray

Your parents will come around, they are missing out on the grand-baby and remember

the family that church & pray together stays together

Op, this is a complicated case, not suited for DIY. I am glad you have an attorney, I hope it is a good one, but you may also want to prepare to look into the possibility of moving to Brazil or another country.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hopefully your attorney is correct and you won't be denied but your case is very complicated. Between the misrepresentation(lying) and her over stay there is no saying what will happen, I hope for the baby's sake you win!
