Hello to all,

First of all, I want to apologize for posting this without reading everything, but I feel so confused right now!

My husband and I are looking at our visa options. Two and a half years ago, his fiancee visa was denied due to previous drug use. We are now looking at refiling. I am currently living in Mexico with him, and we have been married for almost 2 years. I was planning to DCF in Mexico City, but now it is looking like that isnt an option with the Adam Walsh law that was passed. I am planning to go to the US Embassy this week to see if I can file there or not, but as I tend to know more than they do (and you all are so helpful!) I thought that I would check here first.

Now that I am looking at choices, I feel so confused! Should I file IR-1? For sure the benefits would be better, but I would really like my husband to be back in the US for my sister's wedding in December. Is there any chance of that happening with an IR-1? Or should I file a K-3? I have been reading people's timelines to check, but it just so hard to say how much time it would take now...

Also, does anyone have any idea about where I would file? If I can't file in Mexico, should I file to the Nebraska center if I am from Wisconsin?

The last time we did the immigration process was just so frusterating and painful, that I am really not excited about doing it all again...:(

Personally, I think you should get an immigration lawyer. He was denied for either legal or morals reasons before. What has changed? You need help to influence the outcome, more than likely.

The cynic in me says to move to Southern CA and just drive over the border and get him. In LA, Orange and San Diego Counties there is effectively absolutely ZERO enforcement of ANY immigration laws against Mexicans or other Hispanics IF they manage to get in the country. They don't even deport most felons when they finish serving prison terms. And the worst that can happen is you have to drive to Mexico to pick him up again if he somehow manages to get deported. I know if the Mexicans would give my wife a visa to "visit" Mexico City, I'd have her in the country in 2 days and then DEMAND the same rights for her as all the other illegals.

Instead, I jump through the hoops because the only place an illegal will ever get turned away is at an airport. Cynical? Oh yes.

All that said, if you like Wisconsin (Kenosha is nice) then please get a lawyer. Otherwise, welcome to the Mexican State of California where only the gringos have rules.

Thanks for the offer. I did actually live in So.Ca for about a year...4 years ago. I loved it...its where I met my husband.

However, we are trying to do things the right way and bring him into the country legally. (although sometimes I wonder why because it would be so much easier to just have him cross the border!) But I dont want to start a public outcry about illegal immigration. I am looking for information about how to do it the right way. We have already been through a 3 year denial.

I would love to have a lawyer, but unfortunately I can't afford to pay the fees. (remember, I earn pesos, not dollars!) So I will try to do things myself. I have done it before and would have been successful, if not for previous problems my husband had.

So, thanks for the post. ;) I appreciate the idea, but I am going to pass for now. :)

I'm not seriously suggesting you violate the border security or immigration laws of the United States of America. If I was doing that, my name would be George W. Bush, not Jim Powell. I was just pointing out the obvious contradictions in how we as a country choose to shout loudly and angrily with our heads planted completely up our collective arses. There's a war on drugs and you will get shot for walking across the border with drugs. If you live you will get immunity to testify against the agent who didn't kill you. Then you sue the USA and get money to go with your immunity and a Green Card. If you walk across the border to pick vegetables, work in construction or to just rob citizens for fun and profit, you will get free schooling, medical care, amnesty for being illegal, government help in filling out your forms and favorable in-state tuition for college for your kids. You won't need insurance, a driver's license, a SSN or any of the myriad of things us citizens need. Welcome to America, amigo.

Now if you are in fact a citizen, you will face at least a year of hurdles, obstacles, large expenses, capricious and largely unexplainable delays and detours. You will get little or no help or direction from YOUR government. Being born in America is a handicap to Americans.

I sometimes walk into the INS offices located all over this county to ask them questions about my little immigration issues. They look at me like I have two heads. Your wife isn't Mexican, we can't help you. We don't know what to do. All the while, the illegals stand in line and stare holes in me for taking up THEIR precious time. In reality, the agents who meet my plane with machine guns (20% of the time) should be herding all these people into buses for their quick trip to Tijuana.

But by all means, do what is right. Whatever that is....

I think I said get a lawyer. We are 'blessed' with an immigration service that denies visas because you can't produce a picture. I have my doubts about making it through the process with a pristine case, much less one that has been denied once already for cause.

I apologize for my rather ruthful sense of humor regarding the whole process. Those of us 20 miles from the border with Mexico tend to have a fatalistic sense of humor about immigration in general, with Mexico specifically. Suggesting that someone immigrate illegally from Mexico is hardly required, as it is taught and supported with government maps and brochures by the Mexican government itself. My "suggestion" was farsicle on its face.
